Russia,<\/strong><\/p>\n<p>The European Court of Human Rights (Third Section), sitting as a Committee composed of:<br \/>\nDarian Pavli, President,<br \/>\nAndreas Z\u00fcnd,<br \/>\nFr\u00e9d\u00e9ric Krenc, judges,<br \/>\nand Viktoriya Maradudina, Acting Deputy Section Registrar,<\/p>\n<p>Having deliberated in private on 15 September 2022,<\/p>\n<p>Delivers the following judgment, which was adopted on that date:<\/p>\n<p><strong>PROCEDURE<\/strong><\/p>\n<p>1. The case originated in an application against Russia lodged with the Court under Article\u00a034 of the Convention for the Protection of Human Rights and Fundamental Freedoms (\u201cthe Convention\u201d) on 1 April 2019.<\/p>\n<p>2. The Russian Government (\u201cthe\u00a0Government\u201d) were given notice of the application.<\/p>\n<p><strong>THE FACTS<\/strong><\/p>\n<p>3. The applicant\u2019s details and information relevant to the application are set out in the appended table.<\/p>\n<p>4. The applicant complainedof the inadequate conditions of his detention.<\/p>\n<p><strong>THE LAW<\/strong><\/p>\n<p><strong>I. THE GOVERNMENT\u2019S REQUEST TO STRIKE OUT PART OF THE APPLICATION UNDER ARTICLE 37 \u00a7 1 OF THE CONVENTION<\/strong><\/p>\n<p>5. As regards the applicant\u2019s complaints concerning the conditions of his detention in correctional colony no.\u00a0IK-10, Sverdlovsk Region, from 24\u00a0March to 20\u00a0September 2016, the Russian Government (\u201cthe Government\u201d) submitted a declaration with a view to resolving the issues raised by these complaints. They further requested the Court to strike out this part of the application.<\/p>\n<p>6. The Government acknowledged that the conditions of the applicant\u2019s detention in correctional colony no.\u00a0IK-10, Sverdlovsk Region, had not been in compliance with Article\u00a03 of the Convention. They further acknowledged that the applicant had not had an effective remedy in respect of his complaint under Article\u00a03 in contravention of Article\u00a013 of the Convention. They offered to pay the applicant the amount detailed in the appended table and invited the Court to strike the application out of the list of cases in accordance with Article 37 \u00a7 1 (c) of the Convention. The amount would be converted into the currency of the respondent State at the rate applicable on the date of payment, and would be payable within three months from the date of notification of the Court\u2019s decision. In the event of failure to pay this amount within the above-mentioned three-month period, the Government undertook to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.<\/p>\n<p>7. The payment will constitute the final resolution of the case.<\/p>\n<p>8. The applicant accepted the Government\u2019s proposal.<\/p>\n<p>9. The Court finds that, following the applicant\u2019s express agreement to the terms of the declaration made by the Government, the case should be treated as a friendly settlement between the parties.<\/p>\n<p>10. It therefore takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify the continued examination of the application in the part covered by the friendly settlement.<\/p>\n<p>11. In view of the above, it is appropriate to strike out this part of the application.<\/p>\n<p><strong>II. ALLEGED VIOLATION OF ARTICLE\u00a03 OF THE CONVENTION<\/strong><\/p>\n<p>12. The applicant complained of the inadequate conditions of his on\u2011going detention in correctional colony no.\u00a0IK-8, Bashkortostan. He relied on Article 3 of the Convention, which reads as follows:<\/p>\n<p style=\"text-align: center;\">Article 3<\/p>\n<p>\u201cNo one shall be subjected to torture or to inhuman or degrading treatment or punishment.\u201d<\/p>\n<p>13. The Court notes that the applicant has been kept in detention in poor conditions. The details of the applicant\u2019s detention are indicated in the appended table. The Court refers to the principles established in its case\u2011law regarding inadequate conditions of detention (see, for instance, Kud\u0142a\u00a0v.\u00a0Poland [GC], no.\u00a030210\/96, \u00a7\u00a7\u00a090\u201194, ECHR 2000\u2011XI, and Ananyev and Others v.\u00a0Russia, nos.\u00a042525\/07 and\u00a060800\/08, \u00a7\u00a7\u00a0139\u201165, 10\u00a0January 2012). It reiterates in particular that extreme lack of space in a prison cell or overcrowding weighs heavily as an aspect to be taken into account for the purpose of establishing whether the impugned detention conditions were \u201cdegrading\u201d from the point of view of Article\u00a03 and may disclose a violation, both alone or taken together with other shortcomings (see, amongst many authorities, Karalevi\u010dius v.\u00a0Lithuania, no.\u00a053254\/99, \u00a7\u00a7\u00a036\u201340, 7 April 2005).<\/p>\n<p>14. In the leading case of Sergey Babushkin v. Russia, no. 5993\/08, 28\u00a0November 2013, the Court already found a violation in respect of issues similar to those in the present case.<\/p>\n<p>15. Having examined all the material submitted to it, the Court has not found any fact or argument capable of persuading it to reach a different conclusion on the admissibility and merits of these complaints. Having regard to its case-law on the subject, the Court considers that in the instant case the applicant\u2019s conditions of detention were inadequate.<\/p>\n<p>16. This complaint is therefore admissible and discloses a breach of Article 3 of the Convention.<\/p>\n<p><strong>III. APPLICATION OF ARTICLE\u00a041 OF THE CONVENTION<\/strong><\/p>\n<p>17. Article\u00a041 of the Convention provides:<\/p>\n<p>\u201cIf the Court finds that there has been a violation of the Convention or the Protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party.\u201d<\/p>\n<p>18. Regard being had to the documents in its possession and to its case\u2011law (see, in particular, Sergey Babushkin v. Russia, (just satisfaction), no. 5993\/08, 16 October 2014 and Mozharov and Others v.\u00a0Russia, no.\u00a016401\/12 and 9 others, 21 March 2017), the Court considers it reasonable to award the sumindicated in the appended table in respect of its finding a violation of Article 3 of the Convention in the present case.<\/p>\n<p>19. The Court further considers it appropriate that the default interest rate should be based on the marginal lending rate of the European Central Bank, to which should be added three percentage points.<\/p>\n<p><strong>FOR THESE REASONS, THE COURT, UNANIMOUSLY,<\/strong><\/p>\n<p>1. Decides to strike the application in accordance with Article 39 of the Convention, insofar as it relates to the conditions of detention in correctional colony no.\u00a0IK-10, Sverdlovsk Region, out of its list of cases;<\/p>\n<p>2. Declares the remaining part of the application admissible;<\/p>\n<p>3. Holds that this application discloses a breach of Article\u00a03 of the Convention concerning the inadequate conditions of the applicant\u2019s on\u2011going detention in correctional colony no.\u00a0IK-8, Bashkortostan;<\/p>\n<p>4.
