POLAND<\/strong><br \/>\n<em>(Application no. 18590\/18)<\/em><br \/>\nJUDGMENT<br \/>\nSTRASBOURG<br \/>\n15 December 2022<\/p>\n<p>This judgment is final but it may be subject to editorial revision.<\/p>\n<p><strong>In the case of Pi\u0105tkowski v. Poland,<\/strong><\/p>\n<p>The European Court of Human Rights (First Section), sitting as a Committee composed of:<br \/>\nIvana Jeli\u0107, President,<br \/>\nKrzysztof Wojtyczek,<br \/>\nErik Wennerstr\u00f6m, judges,<br \/>\nand Viktoriya Maradudina, Acting Deputy Section Registrar,<\/p>\n<p>Having deliberated in private on 24 November 2022,<\/p>\n<p>Delivers the following judgment, which was adopted on that date:<\/p>\n<p><strong>PROCEDURE<\/strong><\/p>\n<p>1. The case originated in an application against Poland lodged with the Court under Article\u00a034 of the Convention for the Protection of Human Rights and Fundamental Freedoms (\u201cthe Convention\u201d) on 12\u00a0April\u00a02018.<\/p>\n<p>2. The Polish Government (\u201cthe\u00a0Government\u201d) were given notice of the application.<\/p>\n<p><strong>THE FACTS<\/strong><\/p>\n<p>3. The applicant\u2019s details and information relevant to the application are set out in the appended table.<\/p>\n<p>4. The applicant complained of the excessive length of civil proceedings and of the lack of any effective remedy in domestic law.<\/p>\n<p><strong>THE LAW<\/strong><\/p>\n<p><strong>I. ALLEGED VIOLATION OF ARTICLE\u00a06 \u00a7 1 AND\u00a0ARTICLE\u00a013 OF THE CONVENTION<\/strong><\/p>\n<p>5. The applicant complainedthat the length of the civil proceedings in question had been incompatible with the \u201creasonable time\u201d requirement and that he had no effective remedy in this connection. He relied on Article\u00a06 \u00a7 1 and Article\u00a013 of the Convention, which read as follows:<\/p>\n<p style=\"text-align: center;\">Article\u00a06\u00a0\u00a7\u00a01<\/p>\n<p>\u201cIn the determination of his civil rights and obligations &#8230; everyone is entitled to a &#8230; hearing within a reasonable time by [a] &#8230; tribunal &#8230;\u201d<\/p>\n<p style=\"text-align: center;\">Article\u00a013<\/p>\n<p>\u201cEveryone whose rights and freedoms as set forth in [the] Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity.\u201d<\/p>\n<p>6. The Government raised a preliminary objection that the applicant\u00a0can no longer be\u00a0considered a \u201cvictim\u201d, within the meaning of Article\u00a034 of the Convention, of a violation of his right to a\u00a0hearing within a reasonable time since he had been awarded 4,000 Polish zlotys (PLN). The Court notes that this issue falls to be determined in the light of the principles established under the Court\u2019s case-law (seeCocchiarellav.Italy[GC], no.\u00a064886\/01,\u00a7\u00a7\u00a069\u2011107, ECHR 2006\u2011V,andScordinov.Italy (no.1)[GC], no.\u00a036813\/97,\u00a7\u00a7\u00a0178\u2011213, ECHR 2006\u2011V). The applicant disagreed and considered that the award he had obtained domestically had not been satisfactory.<\/p>\n<p>7. The Court notes that the\u00a0\u0141\u00f3d\u017a Regional Court analysed the course of\u00a0the\u00a0impugned proceedings in the light of the criteria which the Court itself applies. On two occasions it concluded that there had been delays for which the domestic authorities should be held responsible, that the applicant\u2019s right to a hearing without unjustified delay had been breached and awarded him the equivalent of\u00a0850 euros (EUR) in respect of the length of the proceedings. The Court finds that the redress provided to the applicant at the domestic level, considered on the basis of the facts of which he complains before the Court, was insufficient (seeJanulisv.Poland, no.31792\/15, \u00a722, 16January 2020, with further examples). In these circumstances, the argument that the applicant has lost his\u00a0victim\u00a0status cannot be upheld.<\/p>\n<p>8. The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see Frydlender v.\u00a0France [GC], no.\u00a030979\/96, \u00a7\u00a043, ECHR 2000-VII).<\/p>\n<p>9. In the leading case of Rutkowski and Others v. Poland, nos.\u00a072287\/10 and 2 others, 7 July 2015, the Court already found a violation in respect of issues similar to those in the present case.<\/p>\n<p>10. Having examined all the material submitted to it, the Court has not found any fact or argument capable of justifying the overall length of the proceedings at the national level. Having regard to its case-law on the subject, the Court considers that in the instant case the length of the proceedings was excessive and failed to meet the \u201creasonable time\u201d requirement.<\/p>\n<p>11. The Court further notes that the applicant did not have at his disposal an effective remedy in respect of these complaints.<\/p>\n<p>12. These complaints are therefore admissible and disclose a breach of Article\u00a06 \u00a7 1 and of Article\u00a013 of the Convention.<\/p>\n<p><strong>II. APPLICATION OF ARTICLE\u00a041 OF THE CONVENTION<\/strong><\/p>\n<p>13. Article 41 of the Convention provides:<\/p>\n<p>\u201cIf the Court finds that there has been a violation of the Convention or the Protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party.\u201d<\/p>\n<p>14. Regard being had to the documents in its possession and to its case\u2011law (see, in particular, Rutkowski and Others, cited above), the Court considers it reasonable to award the sum indicated in the appended table.<\/p>\n<p>15. The Court further considers it appropriate that the default interest rate should be based on the marginal lending rate of the European Central Bank, to which should be added three percentage points.<\/p>\n<p><strong>FOR THESE REASONS, THE COURT, UNANIMOUSLY,<\/strong><\/p>\n<p>1. Declares the application admissible;<\/p>\n<p>2. Holds that this application discloses a breach of Article\u00a06 \u00a7 1 and Article\u00a013 of the Convention concerning the excessive length of civil proceedings and the lack of any effective remedy in domestic law;<\/p>\n<p>3.
