HUNGARY (European Court of Human Rights)"},"content":{"rendered":"<p style=\"text-align: center;\">FOURTH SECTION<\/p>\n<p style=\"text-align: center;\">DECISION<\/p>\n<p style=\"text-align: center;\">Application no. 49045\/14<br \/>\nL\u00e1szl\u00f3 Ferenc BAL\u00c1ZS<br \/>\nagainst Hungary<\/p>\n<p>The European Court of Human Rights (Fourth Section), sitting on 17\u00a0January 2019 as a Committee composed of:<\/p>\n<p>Georges Ravarani, President,<br \/>\nMarko Bo\u0161njak,<br \/>\nP\u00e9ter Paczolay, judges,<\/p>\n<p>and Liv Tigerstedt, Acting Deputy Section Registrar,<\/p>\n<p>Having regard to the above application lodged on 2 June 2014,<\/p>\n<p>Having regard to the observations submitted by the respondent Government,<\/p>\n<p>Having deliberated, decides as follows:<\/p>\n<p>FACTS AND PROCEDURE<\/p>\n<p>The applicant\u2019s details are set out in the appended table.<\/p>\n<p>He was represented by Ms E. Bal\u00e1zsn\u00e9Mohai, a lawyer practising in Budapest.<\/p>\n<p>The applicant\u2019s complaints under Article 6 \u00a7 1 of the Convention concerning the excessive length of criminal proceedings were communicated to the Hungarian Government (\u201cthe Government\u201d).<\/p>\n<p>THE LAW<\/p>\n<p>Complaints underArticle 6 \u00a7 1 of the Convention<\/p>\n<p>In the present application, having examined all the material before it, the Court considers that for the reasons stated below, the respondent Government can no more be held liable for the length of the proceedings.<\/p>\n<p>In particular, the Court notes that the domestic courts expressly acknowledged the protraction of the proceedings and provided adequate redress by taking this circumstance into account as an important mitigating factor when assessing and fixing the criminal sanction.<\/p>\n<p>In view of the above, the Court finds that these complaints are incompatible ratione personae with the provisions of the Convention and must be rejected in accordance with Article\u00a035 \u00a7\u00a7\u00a03 and\u00a04 of the Convention.<\/p>\n<p>For these reasons, the Court, unanimously,<\/p>\n<p>Declares the
