UKRAINE (European Court of Human Rights)"},"content":{"rendered":"<p style=\"text-align: center;\">FIFTH SECTION<\/p>\n<p style=\"text-align: center;\">DECISION<\/p>\n<p style=\"text-align: center;\">Application no.54938\/10<br \/>\nEduard Nikolayevich BOZHKO<br \/>\nagainst Ukraine<\/p>\n<p>The European Court of Human Rights (Fifth Section), sitting on 17\u00a0January 2019 as a Committee composed of:<\/p>\n<p>S\u00edofra O\u2019Leary, President,<br \/>\nM\u0101rti\u0146\u0161 Mits,<br \/>\nLado Chanturia, judges,<\/p>\n<p>and Liv Tigerstedt, Acting Deputy Section Registrar,<\/p>\n<p>Having regard to the above application lodged on 15 March 2011,<\/p>\n<p>Having deliberated, decides as follows:<\/p>\n<p>FACTS AND PROCEDURE<\/p>\n<p>The applicant, Mr Eduard Nikolayevich Bozhko, was born in 1962 and at the time of lodging his application was detained in the Kyiv prison (SIZO no. 13).<\/p>\n<p>The applicant\u2019s complaints under Articles 3, 5 \u00a7\u00a7 1 and 3 and 6\u00a0\u00a7\u00a01 of the Conventionconcerning the alleged ill-treatment in police custody and its investigation, the applicant\u2019s undocumented detention for nineteen hours, the length of his pre-trial detention, the conditions of his detention, and the length of the criminal proceedings against him, were communicated to the Ukrainian Government (\u201cthe Government\u201d), who submitted observations on the admissibility and merits.<\/p>\n<p>By letter dated 31 May 2018, sent by registered post to the applicant\u2019s home address, the applicant was notified that the period allowed for submission of his observations\u00a0had expired on 18 April 2018 and that no extension of time had been requested. The applicant\u2019s attention was drawn to Article\u00a037\u00a0\u00a7\u00a01\u00a0(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The letter returned to the Registry undelivered on 10 August 2018, the applicant having failed to collect the letter from the post office.<\/p>\n<p>Another letter in the same terms, dated 5 September 2018, was sent by registered post to the prison address. The letter was delivered on 17\u00a0September 2018 by proxy.<\/p>\n<p>The last correspondence from the applicant dates back to 2014. Since then, he has not informed the Court whether he was released from or transferred to another prison, nor has he provided another contact address.<\/p>\n<p>THE LAW<\/p>\n<p>In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article\u00a037\u00a0\u00a7\u00a01\u00a0(a) of the Convention).
