An Act<\/p>\n
To amend the Delaware Water Gap National Recreation Area Improvement Act
\nto provide access to certain vehicles serving residents of
\nmunicipalities adjacent to the Delaware Water Gap National Recreation
\nArea, and for other purposes. <<NOTE: Jan. 8, 2018 – [H.R. 560]>><\/p>\n
Be it enacted by the Senate and House of Representatives of the
\nUnited States of America in Congress assembled,
\nSECTION 1. VEHICULAR ACCESS AND FEES.<\/p>\n
Section 4 of the Delaware Water Gap National Recreation Area
\nImprovement Act (Public Law 109-156) <<NOTE: 119 Stat. 2948.>> is
\namended to read as follows:
\n“SEC. 4. USE OF CERTAIN ROADS WITHIN THE RECREATION AREA.<\/p>\n
“(a) In General.–Except as otherwise provided in this section,
\nHighway 209, a federally owned road within the boundaries of the
\nRecreation Area, shall be closed to all commercial vehicles.
\n“(b) Exception for Local Business Use.–Until September 30, 2021,
\nsubsection (a) shall not apply with respect to the use of commercial
\nvehicles that have four or fewer axles and are–
\n“(1) owned and operated by a business physically located
\nin–
\n“(A) the Recreation Area; or
\n“(B) one or more adjacent municipalities; or
\n“(2) necessary to provide services to businesses or persons
\nlocated in–
\n“(A) the Recreation Area; or
\n“(B) one of more adjacent municipalities.<\/p>\n
“(c) Fee.–The Secretary shall establish a fee and permit program
\nfor the use by commercial vehicles of Highway 209 under subsection (b).
\nThe program shall include an annual fee not to exceed $200 per vehicle.
\nAll fees received under the program shall be set aside in a special
\naccount and be available, without further appropriation, to the
\nSecretary for the administration and enforcement of the program,
\nincluding registering vehicles, issuing permits and vehicle
\nidentification stickers, and personnel costs.
\n“(d) Exceptions.–The following vehicles may use Highway 209 and
\nshall not be subject to a fee or permit requirement under subsection
\n(c):
\n“(1) Local school buses.
\n“(2) Fire, ambulance, and other safety and emergency
\nvehicles.
\n“(3) Commercial vehicles using Federal Road Route 209,
\nfrom–
\n“(A) Milford to the Delaware River Bridge leading
\nto U.S. Route 206 in New Jersey; and<\/p>\n

“(B) mile 0 of Federal Road Route 209 to
\nPennsylvania State Route 2001.”.
\nSEC. 2. DEFINITIONS.<\/p>\n
Section 2 of the Delaware Water Gap National Recreation Area
\nImprovement Act (Public Law 109-156) <<NOTE: 119 Stat. 2946.>> is
\namended–
\n(1) by redesignating paragraphs (1) through (5) as
\nparagraphs (2) through (6), respectively; and
\n(2) by inserting before paragraph (2) (as so redesignated by
\nparagraph (1) of this section) the following:
\n“(1) Adjacent municipalities.–The term `adjacent
\nmunicipalities’ means Delaware Township, Dingman Township,
\nLehman Township, Matamoras Borough, Middle Smithfield Township,
\nMilford Borough, Milford Township, Smithfield Township and
\nWestfall Township, in Pennsylvania.”.
\nSEC. 3. CONFORMING AMENDMENT.<\/p>\n
Section 702 of the Omnibus Parks and Public Lands Management Act of
\n1996 (Public Law 104-333) <<NOTE: 110 Stat. 4185.>> is repealed.<\/p>\n
