VEHICULAR ACCESS AND FEES.<\/p>\n<p>Section 4 of the Delaware Water Gap National Recreation Area<br \/>\nImprovement Act (Public Law 109-156) &lt;&lt;NOTE: 119 Stat. 2948.&gt;&gt; is<br \/>\namended to read as follows:<br \/>\n&#8220;SEC. 4. USE OF CERTAIN ROADS WITHIN THE RECREATION AREA.<\/p>\n<p>&#8220;(a) In General.&#8211;Except as otherwise provided in this section,<br \/>\nHighway 209, a federally owned road within the boundaries of the<br \/>\nRecreation Area, shall be closed to all commercial vehicles.<br \/>\n&#8220;(b) Exception for Local Business Use.&#8211;Until September 30, 2021,<br \/>\nsubsection (a) shall not apply with respect to the use of commercial<br \/>\nvehicles that have four or fewer axles and are&#8211;<br \/>\n&#8220;(1) owned and operated by a business physically located<br \/>\nin&#8211;<br \/>\n&#8220;(A) the Recreation Area; or<br \/>\n&#8220;(B) one or more adjacent municipalities; or<br \/>\n&#8220;(2) necessary to provide services to businesses or persons<br \/>\nlocated in&#8211;<br \/>\n&#8220;(A) the Recreation Area; or<br \/>\n&#8220;(B) one of more adjacent municipalities.<\/p>\n<p>&#8220;(c) Fee.&#8211;The Secretary shall establish a fee and permit program<br \/>\nfor the use by commercial vehicles of Highway 209 under subsection (b).<br \/>\nThe program shall include an annual fee not to exceed $200 per vehicle.<br \/>\nAll fees received under the program shall be set aside in a special<br \/>\naccount and be available, without further appropriation, to the<br \/>\nSecretary for the administration and enforcement of the program,<br \/>\nincluding registering vehicles, issuing permits and vehicle<br \/>\nidentification stickers, and personnel costs.<br \/>\n&#8220;(d) Exceptions.&#8211;The following vehicles may use Highway 209 and<br \/>\nshall not be subject to a fee or permit requirement under subsection<br \/>\n(c):<br \/>\n&#8220;(1) Local school buses.<br \/>\n&#8220;(2) Fire, ambulance, and other safety and emergency<br \/>\nvehicles.<br \/>\n&#8220;(3) Commercial vehicles using Federal Road Route 209,<br \/>\nfrom&#8211;<br \/>\n&#8220;(A) Milford to the Delaware River Bridge leading<br \/>\nto U.S. Route 206 in New Jersey; and<\/p>\n<p>[[Page 131 STAT. 2247]]<\/p>\n<p>&#8220;(B) mile 0 of Federal Road Route 209 to<br \/>\nPennsylvania State Route 2001.&#8221;.<br \/>\nSEC. 2. DEFINITIONS.<\/p>\n<p>Section 2 of the Delaware Water Gap National Recreation Area<br \/>\nImprovement Act (Public Law 109-156) &lt;&lt;NOTE: 119 Stat. 2946.&gt;&gt; is<br \/>\namended&#8211;<br \/>\n(1) by redesignating paragraphs (1) through (5) as<br \/>\nparagraphs (2) through (6), respectively; and<br \/>\n(2) by inserting before paragraph (2) (as so redesignated by<br \/>\nparagraph (1) of this section) the following:<br \/>\n&#8220;(1) Adjacent municipalities.&#8211;The term `adjacent<br \/>\nmunicipalities&#8217; means Delaware Township, Dingman Township,<br \/>\nLehman Township, Matamoras Borough, Middle Smithfield Township,<br \/>\nMilford Borough, Milford Township, Smithfield Township and<br \/>\nWestfall Township, in Pennsylvania.&#8221;.<br \/>\nSEC. 3.
