SHORT TITLE; TABLE OF CONTENTS.<\/p>\n<p>(a) Short Title.&#8211;This Act may be cited as the &#8220;Western Oregon<br \/>\nTribal Fairness Act&#8221;.<br \/>\n(b) Table of Contents.&#8211;The table of contents for this Act is as<br \/>\nfollows:<\/p>\n<p>Sec. 1. Land reclassification.<\/p>\n<p>TITLE III&#8211;AMENDMENTS TO COQUILLE RESTORATION ACT<\/p>\n<p>Sec. 301. Amendments to Coquille Restoration Act.<\/p>\n<p>TITLE I&#8211;COW CREEK UMPQUA LAND CONVEYANCE<\/p>\n<p>SEC. 101. DEFINITIONS.<\/p>\n<p>In this title:<br \/>\n(1) Council creek land.&#8211;The term &#8220;Council Creek land&#8221;<br \/>\nmeans the approximately 17,519 acres of land, as generally<br \/>\ndepicted on the map entitled &#8220;Canyon Mountain Land Conveyance&#8221;<br \/>\nand dated May 24, 2016.<br \/>\n(2) Tribe.&#8211;The term &#8220;Tribe&#8221; means the Cow Creek Band of<br \/>\nUmpqua Tribe of Indians.<br \/>\n(3) Secretary.&#8211;The term &#8220;Secretary&#8221; means the Secretary<br \/>\nof the Interior.<br \/>\nSEC. 102. LAND TO BE HELD IN TRUST.<\/p>\n<p>(a) In General.&#8211;Subject to valid existing rights, including rights-<br \/>\nof-way, all right, title, and interest of the United States<\/p>\n<p>[[Page 131 STAT. 2254]]<\/p>\n<p>in and to the Council Creek land, including any improvements located on<br \/>\nthe land, appurtenances to the land, and minerals on or in the land,<br \/>\nincluding oil and gas, shall be&#8211;<br \/>\n(1) held in trust by the United States for the benefit of<br \/>\nthe Tribe; and<br \/>\n(2) part of the reservation of the Tribe.<\/p>\n<p>(b) &lt;&lt;NOTE: Deadline.&gt;&gt; Survey.&#8211;Not later than 2 years after the<br \/>\ndate of enactment of this Act, the Secretary shall complete a survey to<br \/>\nestablish the boundaries of the land taken into trust under subsection<br \/>\n(a).<\/p>\n<p>(c) &lt;&lt;NOTE: Records.&gt;&gt; Effective Date.&#8211;Subsection (a) shall take<br \/>\neffect on the day after the date on which the Secretary records the<br \/>\nagreement entered into under section 104(d)(1).<br \/>\nSEC. 103. MAP AND LEGAL DESCRIPTION.<\/p>\n<p>(a) In General.&#8211;As soon as practicable after the date of enactment<br \/>\nof this Act, the Secretary shall file a map and legal description of the<br \/>\nCouncil Creek land with&#8211;<br \/>\n(1) the Committee on Energy and Natural Resources of the<br \/>\nSenate; and<br \/>\n(2) the Committee on Natural Resources of the House of<br \/>\nRepresentatives.<\/p>\n<p>(b) Force and Effect.&#8211;The map and legal description filed under<br \/>\nsubsection (a) shall have the same force and effect as if included in<br \/>\nthis title, except that the Secretary may correct any clerical or<br \/>\ntypographical errors in the map or legal description.<br \/>\n(c) Public Availability.&#8211;The map and legal description filed under<br \/>\nsubsection (a) shall be on file and available for public inspection in<br \/>\nthe Office of the Secretary.<br \/>\nSEC. 104. ADMINISTRATION.<\/p>\n<p>(a) In General.&#8211;Unless expressly provided in this title, nothing in<br \/>\nthis title affects any right or claim of the Tribe existing on the date<br \/>\nof enactment of this Act to any land or interest in land.<br \/>\n(b) Prohibitions.&#8211;<br \/>\n(1) &lt;&lt;NOTE: Applicability.&gt;&gt; Exports of unprocessed logs.&#8211;<br \/>\nFederal law (including regulations) relating to the export of<br \/>\nunprocessed logs harvested from Federal land shall apply to any<br \/>\nunprocessed logs that are harvested from the Council Creek land.<br \/>\n(2) Non-permissible use of land.&#8211;Any real property taken<br \/>\ninto trust under section 102 shall not be eligible, or used, for<br \/>\nany gaming activity carried out under Public Law 100-497 (25<br \/>\nU.S.C. 2701 et seq.).<\/p>\n<p>(c) Forest Management.&#8211;Any forest management activity that is<br \/>\ncarried out on the Council Creek land shall be managed in accordance<br \/>\nwith all applicable Federal laws.<br \/>\n(d) Agreements.&#8211;<br \/>\n(1) Memorandum of agreement for administrative access.&#8211;Not<br \/>\nlater than 180 days &lt;&lt;NOTE: Deadline.&gt;&gt; after the date of<br \/>\nenactment of this Act, the Secretary shall seek to enter into an<br \/>\nagreement with the Tribe that secures existing administrative<br \/>\naccess by the Secretary to the Council Creek land.<br \/>\n(2) &lt;&lt;NOTE: Effective dates.&gt;&gt; Reciprocal right-of-way<br \/>\nagreements.&#8211;<br \/>\n(A) In general.&#8211;On the date on which the agreement<br \/>\nis entered into under paragraph (1), the Secretary shall<br \/>\nprovide to the Tribe all reciprocal right-of-way<br \/>\nagreements to the Council Creek land in existence as of<br \/>\nthe date of enactment of this Act.<\/p>\n<p>[[Page 131 STAT. 2255]]<\/p>\n<p>(B) Continued access.&#8211;Beginning on the date on<br \/>\nwhich the Council Creek land is taken into trust under<br \/>\nsection 102, the Tribe shall continue the access<br \/>\nprovided by the agreements referred to in subparagraph<br \/>\n(A) in perpetuity.<\/p>\n<p>(e) Land Use Planning Requirements.&#8211;Except as provided in<br \/>\nsubsection (c), once the Council Creek land is taken into trust under<br \/>\nsection 102, the Council Creek land shall not be subject to the land use<br \/>\nplanning requirements of the Federal Land Policy and Management Act of<br \/>\n1976 (43 U.S.C. 1701 et seq.) or the Act of August 28, 1937 (43 U.S.C.<br \/>\n1181a et seq.).<br \/>\nSEC. 105. &lt;&lt;NOTE: Deadlines.&gt;&gt; LAND RECLASSIFICATION.<\/p>\n<p>(a) Identification of Oregon and California Railroad Grant Land.&#8211;<br \/>\nNot later than 180 days after the date of enactment of this Act, the<br \/>\nSecretary of Agriculture and the Secretary shall identify any Oregon and<br \/>\nCalifornia Railroad grant land that is held in trust by the United<br \/>\nStates for the benefit of the Tribe under section 102.<br \/>\n(b) Identification of Public Domain Land.&#8211;Not later than 2 years<br \/>\nafter the date of enactment of this Act, the Secretary shall identify<br \/>\npublic domain land in the State of Oregon that&#8211;<br \/>\n(1) is approximately equal in acreage and condition as the<br \/>\nOregon and California Railroad grant land identified under<br \/>\nsubsection (a); and<br \/>\n(2) is located within the 18 western Oregon and California<br \/>\nRailroad grant land counties (other than Klamath County,<br \/>\nOregon).<\/p>\n<p>(c) &lt;&lt;NOTE: Federal Register, publication.&gt;&gt; Maps.&#8211;Not later than<br \/>\n3 years after the date of enactment of this Act, the Secretary shall<br \/>\nsubmit to Congress and publish in the Federal Register one or more maps<br \/>\ndepicting the land identified in subsections (a) and (b).<\/p>\n<p>(d) Reclassification.&#8211;<br \/>\n(1) In general.&#8211;After providing an opportunity for public<br \/>\ncomment, the Secretary shall reclassify the land identified in<br \/>\nsubsection (b) as Oregon and California Railroad grant land.<br \/>\n(2) Applicability.&#8211;The Act of August 28, 1937 (43 U.S.C.<br \/>\n1181a et seq.), shall apply to land reclassified as Oregon and<br \/>\nCalifornia Railroad grant land under paragraph (1).<\/p>\n<p>TITLE II&#8211;OREGON COASTAL LAND CONVEYANCE<\/p>\n<p>SEC. 201. DEFINITIONS.<\/p>\n<p>In this title:<br \/>\n(1) Confederated tribes.&#8211;The term &#8220;Confederated Tribes&#8221;<br \/>\nmeans the Confederated Tribes of Coos, Lower Umpqua, and Siuslaw<br \/>\nIndians.<br \/>\n(2) Oregon coastal land.&#8211;The term &#8220;Oregon Coastal land&#8221;<br \/>\nmeans the approximately 14,742 acres of land, as generally<br \/>\ndepicted on the map entitled &#8220;Oregon Coastal Land Conveyance&#8221;<br \/>\nand dated July 11, 2016.<br \/>\n(3) Secretary.&#8211;The term &#8220;Secretary&#8221; means the Secretary<br \/>\nof the Interior.<\/p>\n<p>[[Page 131 STAT. 2256]]<\/p>\n<p>SEC. 202. after the date of<br \/>\nenactment of this Act, the Secretary shall seek to enter into an<br \/>\nagreement with the Confederated Tribes that secures existing<br \/>\nadministrative access by the Secretary to the Oregon Coastal<br \/>\nland and that provides for&#8211;<\/p>\n<p>[[Page 131 STAT. 2257]]<\/p>\n<p>(A) access for certain activities, including&#8211;<br \/>\n(i) forest management;<br \/>\n(ii) timber and rock haul;<br \/>\n(iii) road maintenance;<br \/>\n(iv) wildland fire protection and management;<br \/>\n(v) cadastral surveys;<br \/>\n(vi) wildlife, cultural, and other surveys;<br \/>\nand<br \/>\n(vii) law enforcement activities;<br \/>\n(B) the management of the Oregon Coastal land that<br \/>\nis acquired or developed under chapter 2003 of title 54,<br \/>\nUnited States Code, consistent with section 200305(f)(3)<br \/>\nof that title; and<br \/>\n(C) the terms of public vehicular transit across the<br \/>\nOregon Coastal land to and from the Hult Log Storage<br \/>\nReservoir located in T. 15 S., R. 7 W., as generally<br \/>\ndepicted on the map described in section 201(2), subject<br \/>\nto the requirement that if the Bureau of Land Management<br \/>\ndiscontinues maintenance of the public recreation site<br \/>\nknown as &#8220;Hult Reservoir&#8221;, the terms of any agreement<br \/>\nin effect on that date that provides for public<br \/>\nvehicular transit to and from the Hult Log Storage<br \/>\nReservoir shall be void.<br \/>\n(2) &lt;&lt;NOTE: Effective dates.&gt;&gt; Reciprocal right-of-way<br \/>\nagreements.&#8211;<br \/>\n(A) In general.&#8211;On the date on which the agreement<br \/>\nis entered into under paragraph (1), the Secretary shall<br \/>\nprovide to the Confederated Tribes all reciprocal right-<br \/>\nof-way agreements to the Oregon Coastal land in<br \/>\nexistence on the date of enactment of this Act.<br \/>\n(B) Continued access.&#8211;Beginning on the date on<br \/>\nwhich the Oregon Coastal land is taken into trust under<br \/>\nsection 202, the Confederated Tribes shall continue the<br \/>\naccess provided by the reciprocal right-of-way<br \/>\nagreements referred to in subparagraph (A) in<br \/>\nperpetuity.<\/p>\n<p>(e) Land Use Planning Requirements.&#8211;Except as provided in<br \/>\nsubsection (c), once the Oregon Coastal land is taken into trust under<br \/>\nsection 202, the Oregon Coastal land shall not be subject to the land<br \/>\nuse planning requirements of the Federal Land Policy and Management Act<br \/>\nof 1976 (43 U.S.C. 1701 et seq.) or the Act of August 28, 1937 (43<br \/>\nU.S.C. 1181a et seq.).<br \/>\nSEC. 205. &lt;&lt;NOTE: Deadlines.&gt;&gt;
