SHORT TITLE.<\/p>\n<p>This Act may be cited as the &#8220;Jobs for Our Heroes Act&#8221;.<br \/>\nSEC. 2. MEDICAL CERTIFICATE FOR VETERANS OPERATING COMMERCIAL<br \/>\nMOTOR VEHICLES.<\/p>\n<p>(a) Qualified Examiners.&#8211;Section 5403(d)(2) of the FAST Act (49<br \/>\nU.S.C. 31149 note; 129 Stat. 1548) is amended to read as follows:<br \/>\n&#8220;(2) &lt;&lt;NOTE: Definition.&gt;&gt; Qualified examiner.&#8211;The term<br \/>\n`qualified examiner&#8217; means an individual who&#8211;<br \/>\n&#8220;(A) is employed by the Department of Veterans<br \/>\nAffairs as an advanced practice nurse, doctor of<br \/>\nchiropractic, doctor of medicine, doctor of osteopathy,<br \/>\nphysician assistant, or other medical professional;<br \/>\n&#8220;(B) is licensed, certified, or registered in a<br \/>\nState to perform physical examinations;<br \/>\n&#8220;(C) is familiar with the standards for, and<br \/>\nphysical requirements of, an operator required to be<br \/>\nmedically certified under section 31149 of title 49,<br \/>\nUnited States Code; and<br \/>\n&#8220;(D) has never, with respect to such section, been<br \/>\nfound to have acted fraudulently, including by<br \/>\nfraudulently awarding a medical certificate.&#8221;.<\/p>\n<p>(b) Conforming Amendments.&#8211;Section 5403 of the FAST Act (49 U.S.C.<br \/>\n31149 note; 129 Stat. 1548) is amended&#8211;<br \/>\n(1) in subsection (a), by striking &#8220;physician-approved<br \/>\nveteran operator, the qualified physician&#8221; and inserting<br \/>\n&#8220;veteran operator approved by a qualified examiner, the<br \/>\nqualified examiner&#8221;;<br \/>\n(2) in subsection (b)(1)&#8211;<br \/>\n(A) by striking &#8220;the physician&#8221; and inserting<br \/>\n&#8220;the examiner&#8221;; and<br \/>\n(B) by striking &#8220;qualified physician&#8221; and<br \/>\ninserting &#8220;qualified examiner&#8221;;<br \/>\n(3) in subsection (c)&#8211;<br \/>\n(A) by striking &#8220;qualified physicians&#8221; and<br \/>\ninserting &#8220;qualified examiners&#8221;; and<br \/>\n(B) by striking &#8220;such physicians&#8221; and inserting<br \/>\n&#8220;such examiners&#8221;; and<\/p>\n<p>[[Page 131 STAT. 2264]]<\/p>\n<p>(4) in subsection (d)&#8211;<br \/>\n(A) by redesignating paragraphs (1), (2), and (3) as<br \/>\nparagraphs (3), (1), and (2), respectively, and by<br \/>\nmoving the text of paragraph (3), as redesignated, to<br \/>\nappear after paragraph (2), as redesignated; and<br \/>\n(B) in paragraph (3), as redesignated&#8211;<br \/>\n(i) in the paragraph heading, by striking<br \/>\n&#8220;Physician-approved veteran operator&#8221; and<br \/>\ninserting &#8220;Veteran operator approved by a<br \/>\nqualified examiner&#8221;; and<br \/>\n(ii) by striking &#8220;physician-approved veteran<br \/>\noperator&#8221; and inserting &#8220;veteran operator<br \/>\napproved by a qualified examiner&#8221;.<\/p>\n<p>(c) &lt;&lt;NOTE: 49 USC 31149 note.&gt;&gt; Rulemaking.&#8211;The amendments made<br \/>\nby this section shall be incorporated into any rulemaking proceeding<br \/>\nrelated to section 5403 of the FAST Act (49 U.S.C. 31149 note; 129 Stat.<br \/>\n1548) that is being conducted as of the date of the enactment of this<br \/>\nAct.<br \/>\nSEC. 3.
