Hood Wilderness<br \/>\nin the State of Oregon. &lt;&lt;NOTE: Jan. 10, 2018 &#8211; [H.R. 699]&gt;&gt;<\/p>\n<p>Be it enacted by the Senate and House of Representatives of the<br \/>\nUnited States of America in Congress assembled, &lt;&lt;NOTE: Mount Hood<br \/>\nCooper Spur Land Exchange Clarification Act.&gt;&gt;<br \/>\nSECTION 1. SHORT TITLE.<\/p>\n<p>This Act may be cited as the &#8220;Mount Hood Cooper Spur Land Exchange<br \/>\nClarification Act&#8221;.<br \/>\nSEC. 2. COOPER SPUR LAND EXCHANGE CLARIFICATION AMENDMENTS.<\/p>\n<p>Section 1206(a) of the Omnibus Public Land Management Act of 2009<br \/>\n(Public Law 111-11; 123 Stat. 1018) is amended&#8211;<br \/>\n(1) in paragraph (1)&#8211;<br \/>\n(A) in subparagraph (C), by striking &#8220;120 acres&#8221;<br \/>\nand inserting &#8220;107 acres&#8221;; and<br \/>\n(B) in subparagraph (E)(ii), by inserting<br \/>\n&#8220;improvements,&#8221; after &#8220;buildings,&#8221;; and<br \/>\n(2) in paragraph (2)&#8211;<br \/>\n(A) in subparagraph (D)&#8211;<br \/>\n(i) in clause (i), by striking &#8220;As soon as<br \/>\npracticable after the date of enactment of this<br \/>\nAct, the Secretary and Mt. Hood Meadows shall<br \/>\nselect&#8221; and inserting &#8220;Not later than 120<br \/>\ndays &lt;&lt;NOTE: Deadline.&gt;&gt; after the date of the<br \/>\nenactment of the Mount Hood Cooper Spur Land<br \/>\nExchange Clarification Act, the Secretary and Mt.<br \/>\nHood Meadows shall jointly select&#8221;;<br \/>\n(ii) in clause (ii), in the matter preceding<br \/>\nsubclause (I), by striking &#8220;An appraisal under<br \/>\nclause (i) shall&#8221; and inserting &#8220;Except as<br \/>\nprovided under clause (iii), an appraisal under<br \/>\nclause (i) shall assign a separate value to each<br \/>\ntax lot to allow for the equalization of values<br \/>\nand&#8221;; and<br \/>\n(iii) by adding at the end the following:<br \/>\n&#8220;(iii) Final appraised value.&#8211;<br \/>\n&#8220;(I) &lt;&lt;NOTE: Time period. Effective<br \/>\ndate.&gt;&gt; In general.&#8211;Subject to<br \/>\nsubclause (II), after the final<br \/>\nappraised value of the Federal land and<br \/>\nthe non-Federal land are determined and<br \/>\napproved by the Secretary, the Secretary<br \/>\nshall not be required to reappraise or<br \/>\nupdate the final appraised value for a<br \/>\nperiod of up to 3 years, beginning on<br \/>\nthe date of the approval by the<br \/>\nSecretary of the final appraised value.<\/p>\n<p>[[Page 131 STAT. 2271]]<\/p>\n<p>&#8220;(II) Exception.&#8211;Subclause (I)<br \/>\nshall not apply if the condition of<br \/>\neither the Federal land or the non-<br \/>\nFederal land referred to in subclause<br \/>\n(I) is significantly and substantially<br \/>\naltered by fire, windstorm, or other<br \/>\nevents.<br \/>\n&#8220;(iv) Public review.&#8211;Before completing the<br \/>\nland exchange under this Act, the Secretary shall<br \/>\nmake available for public review the complete<br \/>\nappraisals of the land to be exchanged.&#8221;; and<br \/>\n(B) by striking subparagraph (G) and inserting the<br \/>\nfollowing:<br \/>\n&#8220;(G) Required conveyance conditions.&#8211;Prior to the<br \/>\nexchange of the Federal and non-Federal land&#8211;<br \/>\n&#8220;(i) &lt;&lt;NOTE: Conservation.&gt;&gt; the Secretary<br \/>\nand Mt. Hood Meadows may mutually agree for the<br \/>\nSecretary to reserve a conservation easement to<br \/>\nprotect the identified wetland in accordance with<br \/>\napplicable law, subject to the requirements that&#8211;<br \/>\n&#8220;(I) the conservation easement<br \/>\nshall be consistent with the terms of<br \/>\nthe September 30, 2015, mediation<br \/>\nbetween the Secretary and Mt. Hood<br \/>\nMeadows; and<br \/>\n&#8220;(II) &lt;&lt;NOTE: Deadline.&gt;&gt; in order<br \/>\nto take effect, the conservation<br \/>\neasement shall be finalized not later<br \/>\nthan 120 days after the date of<br \/>\nenactment of the Mount Hood Cooper Spur<br \/>\nLand Exchange Clarification Act; and<br \/>\n&#8220;(ii) the Secretary shall reserve a 24-foot-<br \/>\nwide nonexclusive trail easement at the existing<br \/>\ntrail locations on the Federal land that retains<br \/>\nfor the United States existing rights to<br \/>\nconstruct, reconstruct, maintain, and permit<br \/>\nnonmotorized use by the public of existing trails<br \/>\nsubject to the right of the owner of the Federal<br \/>\nland&#8211;<br \/>\n&#8220;(I) to cross the trails with<br \/>\nroads, utilities, and infrastructure<br \/>\nfacilities; and<br \/>\n&#8220;(II) to improve or relocate the<br \/>\ntrails to accommodate development of the<br \/>\nFederal land.<br \/>\n&#8220;(H) Equalization of values.&#8211;<br \/>\n&#8220;(i) In general.&#8211;Notwithstanding<br \/>\nsubparagraph (A), in addition to or in lieu of<br \/>\nmonetary compensation, a lesser area of Federal<br \/>\nland or non-Federal land may be conveyed if<br \/>\nnecessary to equalize appraised values of the<br \/>\nexchange properties, without limitation,<br \/>\nconsistent with the requirements of this Act and<br \/>\nsubject to the approval of the Secretary and Mt.<br \/>\nHood Meadows.<br \/>\n&#8220;(ii) Treatment of certain compensation or<br \/>\nconveyances as donation.&#8211;If, after payment of<br \/>\ncompensation or adjustment of land area subject to<br \/>\nexchange under this Act, the amount by which the<br \/>\nappraised value of the land and other property<br \/>\nconveyed by Mt. Hood Meadows under subparagraph<br \/>\n(A) exceeds the appraised value of the land<br \/>\nconveyed by<\/p>\n<p>[[Page 131 STAT. 2272]]<\/p>\n<p>the Secretary under subparagraph (A) shall be<br \/>\nconsidered a donation by Mt.
