AMENDMENTS TO THE FOREIGN INTELLIGENCE SURVEILLANCE ACT OF<br \/>\n1978.<\/p>\n<p>Except as otherwise expressly provided, whenever in this Act an<br \/>\namendment or repeal is expressed in terms of an amendment to, or a<br \/>\nrepeal of, a section or other provision, the reference shall be<br \/>\nconsidered to be made to a section or other provision of the<\/p>\n<p>[[Page 132 STAT. 4]]<\/p>\n<p>Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801 et seq.).<\/p>\n<p>TITLE I&#8211;ENHANCEMENTS TO FOREIGN INTELLIGENCE COLLECTION AND SAFEGUARDS,<br \/>\nACCOUNTABILITY, AND OVERSIGHT<\/p>\n<p>SEC. 101. QUERYING PROCEDURES REQUIRED.<\/p>\n<p>(a) Querying Procedures.&#8211;<br \/>\n(1) In general.&#8211;Section 702 (50 U.S.C. 1881a) is amended&#8211;<br \/>\n(A) by redesignating subsections (f) through (l) as<br \/>\nsubsections (g) through (m), respectively; and<br \/>\n(B) by inserting after subsection (e) the following<br \/>\nnew subsection:<\/p>\n<p>&#8220;(f) Queries.&#8211;<br \/>\n&#8220;(1) &lt;&lt;NOTE: Consultations.&gt;&gt; Procedures required.&#8211;<br \/>\n&#8220;(A) Requirement to adopt.&#8211;The Attorney General,<br \/>\nin consultation with the Director of National<br \/>\nIntelligence, shall adopt querying procedures consistent<br \/>\nwith the requirements of the fourth amendment to the<br \/>\nConstitution of the United States for information<br \/>\ncollected pursuant to an authorization under subsection<br \/>\n(a).<br \/>\n&#8220;(B) Record of united states person query terms.&#8211;<br \/>\nThe Attorney General, in consultation with the Director<br \/>\nof National Intelligence, shall ensure that the<br \/>\nprocedures adopted under subparagraph (A) include a<br \/>\ntechnical procedure whereby a record is kept of each<br \/>\nUnited States person query term used for a query.<br \/>\n&#8220;(C) Judicial review.&#8211;The procedures adopted in<br \/>\naccordance with subparagraph (A) shall be subject to<br \/>\njudicial review pursuant to subsection (j).<br \/>\n&#8220;(2) Access to results of certain queries conducted by<br \/>\nfbi.&#8211;<br \/>\n&#8220;(A) Court order required for fbi review of certain<br \/>\nquery results in criminal investigations unrelated to<br \/>\nnational security.&#8211;Except as provided by subparagraph<br \/>\n(E), in connection with a predicated criminal<br \/>\ninvestigation opened by the Federal Bureau of<br \/>\nInvestigation that does not relate to the national<br \/>\nsecurity of the United States, the Federal Bureau of<br \/>\nInvestigation may not access the contents of<br \/>\ncommunications acquired under subsection (a) that were<br \/>\nretrieved pursuant to a query made using a United States<br \/>\nperson query term that was not designed to find and<br \/>\nextract foreign intelligence information unless&#8211;<br \/>\n&#8220;(i) the Federal Bureau of Investigation<br \/>\napplies for an order of the Court under<br \/>\nsubparagraph (C); and<br \/>\n&#8220;(ii) the Court enters an order under<br \/>\nsubparagraph (D) approving such application.<br \/>\n&#8220;(B) Jurisdiction.&#8211;The Court shall have<br \/>\njurisdiction to review an application and to enter an<br \/>\norder approving the access described in subparagraph<br \/>\n(A).<\/p>\n<p>[[Page 132 STAT. 5]]<\/p>\n<p>&#8220;(C) Application.&#8211;Each application for an order<br \/>\nunder this paragraph shall be made by a Federal officer<br \/>\nin writing upon oath or affirmation to a judge having<br \/>\njurisdiction under subparagraph (B). Each application<br \/>\nshall require the approval of the Attorney General based<br \/>\nupon the finding of the Attorney General that the<br \/>\napplication satisfies the criteria and requirements of<br \/>\nsuch application, as set forth in this paragraph, and<br \/>\nshall include&#8211;<br \/>\n&#8220;(i) the identity of the Federal officer<br \/>\nmaking the application; and<br \/>\n&#8220;(ii) an affidavit or other information<br \/>\ncontaining a statement of the facts and<br \/>\ncircumstances relied upon by the applicant to<br \/>\njustify the belief of the applicant that the<br \/>\ncontents of communications described in<br \/>\nsubparagraph (A) covered by the application would<br \/>\nprovide evidence of&#8211;<br \/>\n&#8220;(I) criminal activity;<br \/>\n&#8220;(II) contraband, fruits of a<br \/>\ncrime, or other items illegally<br \/>\npossessed by a third party; or<br \/>\n&#8220;(III) property designed for use,<br \/>\nintended for use, or used in committing<br \/>\na crime.<br \/>\n&#8220;(D) &lt;&lt;NOTE: Courts.&gt;&gt; Order.&#8211;Upon an application<br \/>\nmade pursuant to subparagraph (C), the Court shall enter<br \/>\nan order approving the accessing of the contents of<br \/>\ncommunications described in subparagraph (A) covered by<br \/>\nthe application if the Court finds probable cause to<br \/>\nbelieve that such contents would provide any of the<br \/>\nevidence described in subparagraph (C)(ii).<br \/>\n&#8220;(E) Exception.&#8211;The requirement for an order of<br \/>\nthe Court under subparagraph (A) to access the contents<br \/>\nof communications described in such subparagraph shall<br \/>\nnot apply with respect to a query if the Federal Bureau<br \/>\nof Investigation determines there is a reasonable belief<br \/>\nthat such contents could assist in mitigating or<br \/>\neliminating a threat to life or serious bodily harm.<br \/>\n&#8220;(F) Rule of construction.&#8211;Nothing in this<br \/>\nparagraph may be construed as&#8211;<br \/>\n&#8220;(i) limiting the authority of the Federal<br \/>\nBureau of Investigation to conduct lawful queries<br \/>\nof information acquired under subsection (a);<br \/>\n&#8220;(ii) limiting the authority of the Federal<br \/>\nBureau of Investigation to review, without a court<br \/>\norder, the results of any query of information<br \/>\nacquired under subsection (a) that was reasonably<br \/>\ndesigned to find and extract foreign intelligence<br \/>\ninformation, regardless of whether such foreign<br \/>\nintelligence information could also be considered<br \/>\nevidence of a crime; or<br \/>\n&#8220;(iii) prohibiting or otherwise limiting the<br \/>\nability of the Federal Bureau of Investigation to<br \/>\naccess the results of queries conducted when<br \/>\nevaluating whether to open an assessment or<br \/>\npredicated investigation relating to the national<br \/>\nsecurity of the United States.<br \/>\n&#8220;(3) Definitions.&#8211;In this subsection:<br \/>\n&#8220;(A) The term `contents&#8217; has the meaning given that<br \/>\nterm in section 2510(8) of title 18, United States Code.<br \/>\n&#8220;(B) The term `query&#8217; means the use of one or more<br \/>\nterms to retrieve the unminimized contents or<br \/>\nnoncontents<\/p>\n<p>[[Page 132 STAT. 6]]<\/p>\n<p>located in electronic and data storage systems of<br \/>\ncommunications of or concerning United States persons<br \/>\nobtained through acquisitions authorized under<br \/>\nsubsection (a).&#8221;.<br \/>\n(2) &lt;&lt;NOTE: Certifications.&gt;&gt; Application.&#8211;Subsection (f)<br \/>\nof section 702 of the Foreign Intelligence Surveillance Act of<br \/>\n1978 (50 U.S.C. 1881a), as added by paragraph (1), shall apply<br \/>\nwith respect to certifications submitted under subsection (h) of<br \/>\nsuch section to the Foreign Intelligence Surveillance Court<br \/>\nafter January 1, 2018.<\/p>\n<p>(b) Conforming Amendments.&#8211;<br \/>\n(1) Amendments to section 702 of fisa.&#8211;Such section 702 is<br \/>\nfurther amended&#8211;<br \/>\n(A) in subsection (a), by striking &#8220;with subsection<br \/>\n(i)(3)&#8221; and inserting &#8220;with subsection (j)(3)&#8221;;<br \/>\n(B) in subsection (c)&#8211;<br \/>\n(i) in paragraph (1)(B), by striking &#8220;with<br \/>\nsubsection (g)&#8221; and inserting &#8220;with subsection<br \/>\n(h)&#8221;;<br \/>\n(ii) in paragraph (2), by striking &#8220;to<br \/>\nsubsection (i)(3)&#8221; and inserting &#8220;to subsection<br \/>\n(j)(3)&#8221;; and<br \/>\n(iii) in paragraph (3)&#8211;<br \/>\n(I) in subparagraph (A), by striking<br \/>\n&#8220;with subsection (g)&#8221; and inserting<br \/>\n&#8220;with subsection (h)&#8221;; and inserting &#8220;targeting,<br \/>\nminimization, and querying procedures<br \/>\nadopted in accordance with subsections<br \/>\n(d), (e), and (f)(1)&#8221;;<br \/>\n(II) in subparagraph (B), by<br \/>\nstriking &#8220;targeting and minimization<br \/>\nprocedures adopted in accordance with<br \/>\nsubsections (d) and (e)&#8221; and inserting<br \/>\n&#8220;targeting, minimization, and querying<br \/>\nprocedures adopted in accordance with<br \/>\nsubsections (d), (e), and (f)(1)&#8221;; and<br \/>\n(III) in subparagraph (C), by<br \/>\nstriking &#8220;targeting and minimization<br \/>\nprocedures adopted in accordance with<br \/>\nsubsections (d) and (e)&#8221; and<\/p>\n<p>[[Page 132 STAT. 7]]<\/p>\n<p>inserting &#8220;targeting, minimization, and<br \/>\nquerying procedures adopted in<br \/>\naccordance with subsections (d), (e),<br \/>\nand (f)(1)&#8221;;<br \/>\n(ii) in paragraph (2)&#8211;<br \/>\n(I) in subparagraph (A), by striking<br \/>\n&#8220;with subsection (g)&#8221; and inserting<br \/>\n&#8220;with subsection (h)&#8221;; and<br \/>\n(II) by adding at the end the<br \/>\nfollowing:<br \/>\n&#8220;(D) Querying procedures.&#8211;The querying procedures<br \/>\nadopted in accordance with subsection (f)(1) to assess<br \/>\nwhether such procedures comply with the requirements of<br \/>\nsuch subsection.&#8221;;<br \/>\n(iii) in paragraph (3)&#8211;<br \/>\n(I) in subparagraph (A)&#8211;<br \/>\n(aa) by striking &#8220;with<br \/>\nsubsection (g)&#8221; and inserting<br \/>\n&#8220;with subsection (h)&#8221;; and<br \/>\n(bb) by striking &#8220;targeting<br \/>\nand minimization procedures<br \/>\nadopted in accordance with<br \/>\nsubsections (d) and (e)&#8221; each place it<br \/>\nappears and inserting &#8220;section 702(i)&#8221;;<br \/>\n(B) by striking &#8220;section 702(g)&#8221; each place it<br \/>\nappears and inserting &#8220;section 702(h)&#8221;; and<br \/>\n(C) in section 707(b)(1)(G)(ii), by striking<br \/>\n&#8220;subsections (d), (e), and (f)&#8221; and inserting<br \/>\n&#8220;subsections (d), (e), (f)(1), and (g)&#8221;.<br \/>\n(3) Amendments to fisa amendments act of 2008.&#8211;Section 404<br \/>\nof the Foreign Intelligence Surveillance Act of 1978 Amendments<br \/>\nAct of 2008 (Public Law 110-261; 50 U.S.C. 1801 note) is<br \/>\namended&#8211;<br \/>\n(A) in subsection (a)(7)(B)&#8211;<br \/>\n(i) by striking &#8220;under section 702(i)(3)&#8221;<br \/>\nand inserting &#8220;under section 702(j)(3)&#8221;; and<br \/>\n(ii) by striking &#8220;of section 702(i)(4)&#8221; and<br \/>\ninserting &#8220;of section 702(j)(4)&#8221;;<br \/>\n(B) in subsection (b)&#8211;<br \/>\n(i) in paragraph (3)&#8211;<br \/>\n(I) in subparagraph (A), by striking<br \/>\n&#8220;to section 702(h)&#8221; USE AND DISCLOSURE PROVISIONS.<\/p>\n<p>(a) End Use Restriction.&#8211;Section 706(a) (50 U.S.C. 1881e(a)) is<br \/>\namended&#8211;<br \/>\n(1) by striking &#8220;Information acquired&#8221; and inserting the<br \/>\nfollowing:<br \/>\n&#8220;(1) In general.&#8211;Information acquired&#8221;; and<br \/>\n(2) by adding at the end the following:<br \/>\n&#8220;(2) United states persons.&#8211;<br \/>\n&#8220;(A) In general.&#8211;Any information concerning a<br \/>\nUnited States person acquired under section 702 shall<br \/>\nnot be used in evidence against that United States<br \/>\nperson pursuant to paragraph (1) in any criminal<br \/>\nproceeding unless&#8211;<br \/>\n&#8220;(i) the Federal Bureau of Investigation<br \/>\nobtained an order of the Foreign Intelligence<br \/>\nSurveillance Court to access such information<br \/>\npursuant to section 702(f)(2); or<br \/>\n&#8220;(ii) &lt;&lt;NOTE: Determination.&gt;&gt; the Attorney<br \/>\nGeneral determines that&#8211;<br \/>\n&#8220;(I) the criminal proceeding<br \/>\naffects, involves, or is related to the<br \/>\nnational security of the United States;<br \/>\nor<br \/>\n&#8220;(II) the criminal proceeding<br \/>\ninvolves&#8211;<br \/>\n&#8220;(aa) death;<br \/>\n&#8220;(bb) kidnapping;<\/p>\n<p>[[Page 132 STAT. 9]]<\/p>\n<p>&#8220;(cc) serious bodily<br \/>\ninjury, as defined in section<br \/>\n1365 of title 18, United States<br \/>\nCode;<br \/>\n&#8220;(dd) conduct that<br \/>\nconstitutes a criminal offense<br \/>\nthat is a specified offense<br \/>\nagainst a minor, as defined in<br \/>\nsection 111 of the Adam Walsh<br \/>\nChild Protection and Safety Act<br \/>\nof 2006 (34 U.S.C. 20911);<br \/>\n&#8220;(ee) incapacitation or<br \/>\ndestruction of critical<br \/>\ninfrastructure, as defined in<br \/>\nsection 1016(e) of the USA<br \/>\nPATRIOT Act (42 U.S.C.<br \/>\n5195c(e));<br \/>\n&#8220;(ff) cybersecurity,<br \/>\nincluding conduct described in<br \/>\nsection 1016(e) of the USA<br \/>\nPATRIOT Act (42 U.S.C. 5195c(e))<br \/>\nor section 1029, 1030, or 2511<br \/>\nof title 18, United States Code;<br \/>\n&#8220;(gg) transnational crime,<br \/>\nincluding transnational<br \/>\nnarcotics trafficking and<br \/>\ntransnational organized crime;<br \/>\nor<br \/>\n&#8220;(hh) human trafficking.<br \/>\n&#8220;(B) No judicial review.&#8211;A determination by the<br \/>\nAttorney General under subparagraph (A)(ii) is not<br \/>\nsubject to judicial review.&#8221;.<\/p>\n<p>(b) Intelligence Community Disclosure Provision.&#8211;Section 603 (50<br \/>\nU.S.C. 1873) is amended&#8211;<br \/>\n(1) in subsection (b)&#8211;<br \/>\n(A) in paragraph (1), by striking &#8220;good faith<br \/>\nestimate of the number of targets of such orders;&#8221; and<br \/>\ninserting the following: &#8220;good faith estimate of&#8211;<br \/>\n&#8220;(A) the number of targets of such orders;<br \/>\n&#8220;(B) the number of targets of such orders who are<br \/>\nknown to not be United States persons; and<br \/>\n&#8220;(C) the number of targets of such orders who are<br \/>\nknown to be United States persons;&#8221;;<br \/>\n(B) in paragraph (2)&#8211;<br \/>\n(i) in the matter preceding subparagraph (A),<br \/>\nby inserting &#8220;, including pursuant to subsection<br \/>\n(f)(2) of such section,&#8221; after &#8220;section 702&#8221;;<br \/>\n(ii) by redesignating subparagraphs (A) and<br \/>\n(B) as subparagraphs (B) and (C), respectively;<br \/>\n(iii) by inserting before subparagraph (B), as<br \/>\nso redesignated, the following:<br \/>\n&#8220;(A) the number of targets of such orders;&#8221;;<br \/>\n(iv) in subparagraph (B), as so redesignated,<br \/>\nby striking &#8220;and&#8221; at the end; and<br \/>\n(v) by adding at the end the following:<br \/>\n&#8220;(D) the number of instances in which the Federal<br \/>\nBureau of Investigation opened, under the Criminal<br \/>\nInvestigative Division or any successor division, an<br \/>\ninvestigation of a United States person (who is not<br \/>\nconsidered a threat to national security) based wholly<br \/>\nor in part on an acquisition authorized under such<br \/>\nsection;&#8221;;<br \/>\n(C) in paragraph (3)(A), by striking &#8220;orders; and&#8221;<br \/>\nand inserting the following: &#8220;orders, including&#8211;<br \/>\n&#8220;(i) the number of targets of such orders who<br \/>\nare known to not be United States persons; and<\/p>\n<p>[[Page 132 STAT. 10]]<\/p>\n<p>&#8220;(ii) the number of targets of such orders<br \/>\nwho are known to be United States persons; and&#8221;;<br \/>\n(D) by redesignating paragraphs (4), (5), and (6) as<br \/>\nparagraphs (5), (6), and (7), respectively; and<br \/>\n(E) by inserting after paragraph (3) the following:<br \/>\n&#8220;(4) the number of criminal proceedings in which the United<br \/>\nStates or a State or political subdivision thereof provided<br \/>\nnotice pursuant to subsection (c) or (d) of section 106<br \/>\n(including with respect to information acquired from an<br \/>\nacquisition conducted under section 702) or subsection (d) or<br \/>\n(e) of section 305 of the intent of the government to enter into<br \/>\nevidence or otherwise use or disclose any information obtained<br \/>\nor derived from electronic surveillance, physical search, or an<br \/>\nacquisition conducted pursuant to this Act;&#8221;; and<br \/>\n(2) in subsection (d)&#8211;<br \/>\n(A) in paragraph (1), by striking &#8220;(4), or (5)&#8221;<br \/>\nand inserting &#8220;(5), or (6)&#8221;;<br \/>\n(B) in paragraph (2)(A)&#8211;<br \/>\n(i) by striking &#8220;Paragraphs (2)(A), (2)(B),<br \/>\nand (5)(C)&#8221; and inserting &#8220;Paragraphs (2)(B),<br \/>\n(2)(C), and (6)(C)&#8221;; and<br \/>\n(ii) by inserting before the period at the end<br \/>\nthe following: &#8220;, except with respect to<br \/>\ninformation required under paragraph (2) relating<br \/>\nto orders issued under section 702(f)(2)&#8221;; and<br \/>\n(C) in paragraph (3)(A), in the matter preceding<br \/>\nclause (i), by striking &#8220;subsection (b)(2)(B)&#8221; and<br \/>\ninserting &#8220;subsection (b)(2)(C)&#8221;.<br \/>\nSEC. 103. CONGRESSIONAL REVIEW AND OVERSIGHT OF ABOUTS COLLECTION.<\/p>\n<p>(a) In General.&#8211;Section 702(b) (50 U.S.C. 1881a(b)) is amended&#8211;<br \/>\n(1) in paragraph (4), by striking &#8220;and&#8221; at the end;<br \/>\n(2) by redesignating paragraph (5) as paragraph (6); and<br \/>\n(3) by inserting after paragraph (4) the following:<br \/>\n&#8220;(5) may not intentionally acquire communications that<br \/>\ncontain a reference to, but are not to or from, a target of an<br \/>\nacquisition authorized under subsection (a), except as provided<br \/>\nunder section 103(b) of the FISA Amendments Reauthorization Act<br \/>\nof 2017; and&#8221;.<\/p>\n<p>(b) &lt;&lt;NOTE: 50 USC 1881a note.&gt;&gt; Congressional Review and Oversight<br \/>\nof Abouts Collection.&#8211;<br \/>\n(1) Definitions.&#8211;In this subsection:<br \/>\n(A) The term &#8220;abouts communication&#8221; means a<br \/>\ncommunication that contains a reference to, but is not<br \/>\nto or from, a target of an acquisition authorized under<br \/>\nsection 702(a) of the Foreign Intelligence Surveillance<br \/>\nAct of 1978 (50 U.S.C. 1881a(a)).<br \/>\n(B) The term &#8220;material breach&#8221; means significant<br \/>\nnoncompliance with applicable law or an order of the<br \/>\nForeign Intelligence Surveillance Court concerning any<br \/>\nacquisition of abouts communications.<br \/>\n(2) Submission to congress.&#8211;<br \/>\n(A) &lt;&lt;NOTE: Notice.&gt;&gt; Requirement.&#8211;Notwithstanding<br \/>\nany other provision of law, and except as provided in<br \/>\nparagraph (4), if<\/p>\n<p>[[Page 132 STAT. 11]]<\/p>\n<p>the Attorney General and the Director of National<br \/>\nIntelligence intend to implement the authorization of<br \/>\nthe intentional acquisition of abouts communications,<br \/>\nbefore the first such implementation after the date of<br \/>\nenactment of this Act, the Attorney General and the<br \/>\nDirector of National Intelligence shall submit to the<br \/>\nCommittee on the Judiciary and the Select Committee on<br \/>\nIntelligence of the Senate and the Committee on the<br \/>\nJudiciary and the Permanent Select Committee on<br \/>\nIntelligence of the House of Representatives a written<br \/>\nnotice of the intent to implement the authorization of<br \/>\nsuch an acquisition, and any supporting materials in<br \/>\naccordance with this subsection.<br \/>\n(B) &lt;&lt;NOTE: Effective date. Hearings. Briefings.&gt;&gt;<br \/>\nCongressional review period.&#8211;During the 30-day period<br \/>\nbeginning on the date written notice is submitted under<br \/>\nsubparagraph (A), the Committee on the Judiciary and the<br \/>\nSelect Committee on Intelligence of the Senate and the<br \/>\nCommittee on the Judiciary and the Permanent Select<br \/>\nCommittee on Intelligence of the House of<br \/>\nRepresentatives shall, as appropriate, hold hearings and<br \/>\nbriefings and otherwise obtain information in order to<br \/>\nfully review the written notice.<br \/>\n(C) &lt;&lt;NOTE: Determination.&gt;&gt; Limitation on action<br \/>\nduring congressional review period.&#8211;Notwithstanding any<br \/>\nother provision of law, and subject to paragraph (4),<br \/>\nunless the Attorney General and the Director of National<br \/>\nIntelligence make a determination pursuant to section<br \/>\n702(c)(2) of the Foreign Intelligence Surveillance Act<br \/>\nof 1978 (50 U.S.C. 1881a(c)(2)), the Attorney General<br \/>\nand the Director of National Intelligence may not<br \/>\nimplement the authorization of the intentional<br \/>\nacquisition of abouts communications before the end of<br \/>\nthe period described in subparagraph (B).<br \/>\n(3) &lt;&lt;NOTE: Records.&gt;&gt; Written notice.&#8211;Written notice<br \/>\nunder paragraph (2)(A) shall include the following:<br \/>\n(A) &lt;&lt;NOTE: Certification.&gt;&gt; A copy of any<br \/>\ncertification submitted to the Foreign Intelligence<br \/>\nSurveillance Court pursuant to section 702 of the<br \/>\nForeign Intelligence Surveillance Act of 1978 (50 U.S.C.<br \/>\n1881a), or amendment thereto, authorizing the<br \/>\nintentional acquisition of abouts communications,<br \/>\nincluding all affidavits, procedures, exhibits, and<br \/>\nattachments submitted therewith.<br \/>\n(B) The decision, order, or opinion of the Foreign<br \/>\nIntelligence Surveillance Court approving such<br \/>\ncertification, and any pleadings, applications, or<br \/>\nmemoranda of law associated with such decision, order,<br \/>\nor opinion.<br \/>\n(C) A summary of the protections in place to detect<br \/>\nany material breach.<br \/>\n(D) Data or other results of modeling, simulation,<br \/>\nor auditing of sample data demonstrating that any<br \/>\nacquisition method involving the intentional acquisition<br \/>\nof abouts communications shall be conducted in<br \/>\naccordance with title VII of the Foreign Intelligence<br \/>\nSurveillance Act of 1978 (50 U.S.C. 1881 et seq.), if<br \/>\nsuch data or other results exist at the time the written<br \/>\nnotice is submitted and were provided to the Foreign<br \/>\nIntelligence Surveillance Court.<br \/>\n(E) Except as provided under paragraph (4), a<br \/>\nstatement that no acquisition authorized under<br \/>\nsubsection (a)<\/p>\n<p>[[Page 132 STAT. 12]]<\/p>\n<p>of such section 702 shall include the intentional<br \/>\nacquisition of an abouts communication until after the<br \/>\nend of the 30-day period described in paragraph (2)(B).<br \/>\n(4) Exception for emergency acquisition.&#8211;<br \/>\n(A) &lt;&lt;NOTE: Deadline.&gt;&gt; Notice of determination.&#8211;<br \/>\nIf the Attorney General and the Director of National<br \/>\nIntelligence make a determination pursuant to section<br \/>\n702(c)(2) of the Foreign Intelligence Surveillance Act<br \/>\nof 1978 (50 U.S.C. 1881a(c)(2)) with respect to the<br \/>\nintentional acquisition of abouts communications, the<br \/>\nAttorney General and the Director of National<br \/>\nIntelligence shall notify the Committee on the Judiciary<br \/>\nand the Select Committee on Intelligence of the Senate<br \/>\nand the Committee on the Judiciary and the Permanent<br \/>\nSelect Committee on Intelligence of the House of<br \/>\nRepresentatives as soon as practicable, but not later<br \/>\nthan 7 days after the determination is made.<br \/>\n(B) Implementation or continuation.&#8211;<br \/>\n(i) &lt;&lt;NOTE: Certification. Determination.&gt;&gt;<br \/>\nIn general.&#8211;If the Foreign Intelligence<br \/>\nSurveillance Court approves a certification that<br \/>\nauthorizes the intentional acquisition of abouts<br \/>\ncommunications before the end of the 30-day period<br \/>\ndescribed in paragraph (2)(B), the Attorney<br \/>\nGeneral and the Director of National Intelligence<br \/>\nmay authorize the immediate implementation or<br \/>\ncontinuation of that certification if the Attorney<br \/>\nGeneral and the Director of National Intelligence<br \/>\njointly determine that exigent circumstances exist<br \/>\nsuch that without such immediate implementation or<br \/>\ncontinuation intelligence important to the<br \/>\nnational security of the United States may be lost<br \/>\nor not timely acquired.<br \/>\n(ii) &lt;&lt;NOTE: Determination. Deadline.&gt;&gt;<br \/>\nNotice.&#8211;The Attorney General and the Director of<br \/>\nNational Intelligence shall submit to the<br \/>\nCommittee on the Judiciary and the Select<br \/>\nCommittee on Intelligence of the Senate and the<br \/>\nCommittee on the Judiciary and the Permanent<br \/>\nSelect Committee on Intelligence of the House of<br \/>\nRepresentatives notification of a determination<br \/>\npursuant to clause (i) as soon as practicable, but<br \/>\nnot later than 3 days after the determination is<br \/>\nmade.<br \/>\n(5) Reporting of material breach.&#8211;Subsection (m) of section<br \/>\n702 (50 U.S.C. 1881a), as redesignated by section 101, is<br \/>\namended&#8211;<br \/>\n(A) in the heading by striking &#8220;and Reviews&#8221; and<br \/>\ninserting &#8220;Reviews, and Reporting&#8221;; and<br \/>\n(B) by adding at the end the following new<br \/>\nparagraph:<br \/>\n&#8220;(4) Reporting of material breach.&#8211;<br \/>\n&#8220;(A) In general.&#8211;The head of each element of the<br \/>\nintelligence community involved in the acquisition of<br \/>\nabouts communications shall fully and currently inform<br \/>\nthe Committees on the Judiciary of the House of<br \/>\nRepresentatives and the Senate and the congressional<br \/>\nintelligence committees of a material breach.<br \/>\n&#8220;(B) Definitions.&#8211;In this paragraph:<br \/>\n&#8220;(i) The term `abouts communication&#8217; means a<br \/>\ncommunication that contains a reference to, but is<br \/>\nnot to or from, a target of an acquisition<br \/>\nauthorized under subsection (a).<\/p>\n<p>[[Page 132 STAT. 13]]<\/p>\n<p>&#8220;(ii) The term `material breach&#8217; means<br \/>\nsignificant noncompliance with applicable law or<br \/>\nan order of the Foreign Intelligence Surveillance<br \/>\nCourt concerning any acquisition of abouts<br \/>\ncommunications.&#8221;.<br \/>\n(6) Appointment of amici curiae by foreign intelligence<br \/>\nsurveillance court.&#8211;For purposes of section 103(i)(2)(A) of the<br \/>\nForeign Intelligence Surveillance Act of 1978 (50 U.S.C.<br \/>\n1803(i)(2)(A)), the Foreign Intelligence Surveillance Court<br \/>\nshall treat the first certification under section 702(h) of such<br \/>\nAct (50 U.S.C. 1881a(h)) or amendment thereto that authorizes<br \/>\nthe acquisition of abouts communications as presenting a novel<br \/>\nor significant interpretation of the law, unless the court<br \/>\ndetermines otherwise.<br \/>\nSEC. 104. PUBLICATION OF MINIMIZATION PROCEDURES UNDER SECTION<br \/>\n702.<\/p>\n<p>Section 702(e) (50 U.S.C. 1881a(e)) is amended by adding at the end<br \/>\nthe following new paragraph:<br \/>\n&#8220;(3) &lt;&lt;NOTE: Consultation.&gt;&gt; Publication.&#8211;The Director of<br \/>\nNational Intelligence, in consultation with the Attorney<br \/>\nGeneral, shall&#8211;<br \/>\n&#8220;(A) conduct a declassification review of any<br \/>\nminimization procedures adopted or amended in accordance<br \/>\nwith paragraph (1); and<br \/>\n&#8220;(B) consistent with such review, and not later<br \/>\nthan 180 days after conducting such review, make such<br \/>\nminimization procedures publicly available to the<br \/>\ngreatest extent practicable, which may be in redacted<br \/>\nform.&#8221;.<br \/>\nSEC. 105. SECTION 705 EMERGENCY PROVISION.<\/p>\n<p>Section 705 (50 U.S.C. 1881d) is amended by adding at the end the<br \/>\nfollowing:<br \/>\n&#8220;(c) Emergency Authorization.&#8211;<br \/>\n&#8220;(1) Concurrent authorization.&#8211;If the Attorney General<br \/>\nauthorized the emergency employment of electronic surveillance<br \/>\nor a physical search pursuant to section 105 or 304, the<br \/>\nAttorney General may authorize, for the effective period of the<br \/>\nemergency authorization and subsequent order pursuant to section<br \/>\n105 or 304, without a separate order under section 703 or 704,<br \/>\nthe targeting of a United States person subject to such<br \/>\nemergency employment for the purpose of acquiring foreign<br \/>\nintelligence information while such United States person is<br \/>\nreasonably believed to be located outside the United States.<br \/>\n&#8220;(2) Use of information.&#8211;If an application submitted to<br \/>\nthe Court pursuant to section 104 or 303 is denied, or in any<br \/>\nother case in which the acquisition pursuant to paragraph (1) is<br \/>\nterminated and no order with respect to the target of the<br \/>\nacquisition is issued under section 105 or 304, all information<br \/>\nobtained or evidence derived from such acquisition shall be<br \/>\nhandled in accordance with section 704(d)(4).&#8221;.<br \/>\nSEC. 106. COMPENSATION OF AMICI CURIAE AND TECHNICAL EXPERTS.<\/p>\n<p>Subsection (i) of section 103 (50 U.S.C. 1803) is amended by adding<br \/>\nat the end the following:<br \/>\n&#8220;(11) Compensation.&#8211;Notwithstanding any other provision of<br \/>\nlaw, a court established under subsection (a) or (b) may<br \/>\ncompensate an amicus curiae appointed under paragraph<\/p>\n<p>[[Page 132 STAT. 14]]<\/p>\n<p>(2) for assistance provided under such paragraph as the court<br \/>\nconsiders appropriate and at such rate as the court considers<br \/>\nappropriate.&#8221;.<br \/>\nSEC. 107. ADDITIONAL REPORTING REQUIREMENTS.<\/p>\n<p>(a) Electronic Surveillance.&#8211;Section 107 (50 U.S.C. 1807) is<br \/>\namended to read as follows:<br \/>\n&#8220;SEC. 107. REPORT OF ELECTRONIC SURVEILLANCE.<\/p>\n<p>&#8220;(a) Annual Report.&#8211;In April of each year, the Attorney General<br \/>\nshall transmit to the Administrative Office of the United States Courts<br \/>\nand to the congressional intelligence committees and the Committees on<br \/>\nthe Judiciary of the House of Representatives and the Senate a report<br \/>\nsetting forth with respect to the preceding calendar year&#8211;<br \/>\n&#8220;(1) the total number of applications made for orders and<br \/>\nextensions of orders approving electronic surveillance under<br \/>\nthis title;<br \/>\n&#8220;(2) the total number of such orders and extensions either<br \/>\ngranted, modified, or denied; and<br \/>\n&#8220;(3) the total number of subjects targeted by electronic<br \/>\nsurveillance conducted under an order or emergency authorization<br \/>\nunder this title, rounded to the nearest 500, including the<br \/>\nnumber of such individuals who are United States persons,<br \/>\nreported to the nearest band of 500, starting with 0-499.<\/p>\n<p>&#8220;(b) Form.&#8211;Each report under subsection (a) shall be submitted in<br \/>\nunclassified form, to the extent consistent with national security. Not<br \/>\nlater than 7 days &lt;&lt;NOTE: Public information. Determination.&gt;&gt; after<br \/>\nthe date on which the Attorney General submits each such report, the<br \/>\nAttorney General shall make the report publicly available, or, if the<br \/>\nAttorney General determines that the report cannot be made publicly<br \/>\navailable consistent with national security, the Attorney General may<br \/>\nmake publicly available an unclassified summary of the report or a<br \/>\nredacted version of the report.&#8221;.<\/p>\n<p>(b) Pen Registers and Trap and Trace Devices.&#8211;Section 406 (50<br \/>\nU.S.C. 1846) is amended&#8211;<br \/>\n(1) in subsection (b)&#8211;<br \/>\n(A) in paragraph (4), by striking &#8220;; and&#8221; and<br \/>\ninserting a semicolon;<br \/>\n(B) in paragraph (5), by striking the period at the<br \/>\nend and inserting &#8220;; and&#8221;; and<br \/>\n(C) by adding at the end the following new<br \/>\nparagraph:<br \/>\n&#8220;(6) a good faith estimate of the total number of subjects<br \/>\nwho were targeted by the installation and use of a pen register<br \/>\nor trap and trace device under an order or emergency<br \/>\nauthorization issued under this title, rounded to the nearest<br \/>\n500, including&#8211;<br \/>\n&#8220;(A) the number of such subjects who are United<br \/>\nStates persons, reported to the nearest band of 500,<br \/>\nstarting with 0-499; and<br \/>\n&#8220;(B) of the number of United States persons<br \/>\ndescribed in subparagraph (A), the number of persons<br \/>\nwhose information acquired pursuant to such order was<br \/>\nreviewed or accessed by a Federal officer, employee, or<br \/>\nagent, reported to the nearest band of 500, starting<br \/>\nwith 0-499.&#8221;; and<br \/>\n(2) by adding at the end the following new subsection:<\/p>\n<p>&#8220;(c) Each report under subsection (b) shall be submitted in<br \/>\nunclassified form, to the extent consistent with national security.<\/p>\n<p>[[Page 132 STAT. 15]]<\/p>\n<p>Not later than 7 days &lt;&lt;NOTE: Deadline. Determination.&gt;&gt; after the date<br \/>\non which the Attorney General submits such a report, the Attorney<br \/>\nGeneral shall make the report publicly available, or, if the Attorney<br \/>\nGeneral determines that the report cannot be made publicly available<br \/>\nconsistent with national security, the Attorney General may make<br \/>\npublicly available an unclassified summary of the report or a redacted<br \/>\nversion of the report.&#8221;.<br \/>\nSEC. 108. IMPROVEMENTS TO PRIVACY AND CIVIL LIBERTIES OVERSIGHT<br \/>\nBOARD.<\/p>\n<p>(a) Appointment of Staff.&#8211;Subsection (j) of section 1061 of the<br \/>\nIntelligence Reform and Terrorism Prevention Act of 2004 (42 U.S.C.<br \/>\n2000ee(j)) is amended&#8211;<br \/>\n(1) by redesignating paragraphs (2) and (3) as paragraphs<br \/>\n(3) and (4), respectively; and<br \/>\n(2) by inserting after paragraph (1) the following new<br \/>\nparagraph:<br \/>\n&#8220;(2) Appointment in absence of chairman.&#8211;If the position<br \/>\nof chairman of the Board is vacant, during the period of the<br \/>\nvacancy, the Board, at the direction of the unanimous vote of<br \/>\nthe serving members of the Board, may exercise the authority of<br \/>\nthe chairman under paragraph (1).&#8221;.<\/p>\n<p>(b) Meetings.&#8211;Subsection (f) of such section (42 U.S.C. 2000ee(f))<br \/>\nis amended&#8211;<br \/>\n(1) by striking &#8220;The Board shall&#8221; and inserting &#8220;The<br \/>\nBoard&#8221;;<br \/>\n(2) in paragraph (1) by striking &#8220;make its&#8221; and inserting<br \/>\n&#8220;shall make its&#8221;; and<br \/>\n(3) in paragraph (2)&#8211;<br \/>\n(A) by striking &#8220;hold public&#8221; and inserting<br \/>\n&#8220;shall hold public&#8221;; and<br \/>\n(B) by inserting before the period at the end the<br \/>\nfollowing: &#8220;, but may, notwithstanding section 552b of<br \/>\ntitle 5, United States Code, meet or otherwise<br \/>\ncommunicate in any number to confer or deliberate in a<br \/>\nmanner that is closed to the public&#8221;.<br \/>\nSEC. 109. PRIVACY AND CIVIL LIBERTIES OFFICERS.<\/p>\n<p>Section 1062(a) of the Intelligence Reform and Terrorism Prevention<br \/>\nAct of 2004 (42 U.S.C. 2000ee-1(a)) is amended by inserting &#8220;, the<br \/>\nDirector of the National Security Agency, the Director of the Federal<br \/>\nBureau of Investigation&#8221; after &#8220;the Director of the Central<br \/>\nIntelligence Agency&#8221;.<br \/>\nSEC. 110. WHISTLEBLOWER PROTECTIONS FOR CONTRACTORS OF THE<br \/>\nINTELLIGENCE COMMUNITY.<\/p>\n<p>(a) Prohibited Personnel Practices in the Intelligence Community.&#8211;<br \/>\nSection 1104 of the National Security Act of 1947 (50 U.S.C. 3234) is<br \/>\namended&#8211;<br \/>\n(1) in subsection (a)&#8211;<br \/>\n(A) in paragraph (3), by inserting &#8220;or a contractor<br \/>\nemployee&#8221; after &#8220;character)&#8221;; and<br \/>\n(B) by adding at the end the following new<br \/>\nparagraph:<br \/>\n&#8220;(4) &lt;&lt;NOTE: Definition.&gt;&gt; Contractor employee.&#8211;The term<br \/>\n`contractor employee&#8217; means an employee of a contractor,<br \/>\nsubcontractor, grantee, subgrantee, or personal services<br \/>\ncontractor, of a covered intelligence community element.&#8221;;<br \/>\n(2) by redesignating subsections (c) and (d) as subsections<br \/>\n(d) and (e), respectively;<\/p>\n<p>[[Page 132 STAT. 16]]<\/p>\n<p>(3) by inserting after subsection (b) the following new<br \/>\nsubsection (c):<\/p>\n<p>&#8220;(c) Contractor Employees.&#8211;(1) Any employee of a contractor,<br \/>\nsubcontractor, grantee, subgrantee, or personal services contractor, of<br \/>\na covered intelligence community element who has authority to take,<br \/>\ndirect others to take, recommend, or approve any personnel action, shall<br \/>\nnot, with respect to such authority, take or fail to take a personnel<br \/>\naction with respect to any contractor employee as a reprisal for a<br \/>\nlawful disclosure of information by the contractor employee to the<br \/>\nDirector of National Intelligence (or an employee designated by the<br \/>\nDirector of National Intelligence for such purpose), the Inspector<br \/>\nGeneral of the Intelligence Community, the head of the contracting<br \/>\nagency (or an employee designated by the head of that agency for such<br \/>\npurpose), the appropriate inspector general of the contracting agency, a<br \/>\ncongressional intelligence committee, or a member of a congressional<br \/>\nintelligence committee, which the contractor employee reasonably<br \/>\nbelieves evidences&#8211;<br \/>\n&#8220;(A) a violation of any Federal law, rule, or regulation<br \/>\n(including with respect to evidence of another employee or<br \/>\ncontractor employee accessing or sharing classified information<br \/>\nwithout authorization); or<br \/>\n&#8220;(B) gross mismanagement, a gross waste of funds, an abuse<br \/>\nof authority, or a substantial and specific danger to public<br \/>\nhealth or safety.<\/p>\n<p>&#8220;(2) A personnel action under paragraph (1) is prohibited even if<br \/>\nthe action is undertaken at the request of an agency official, unless<br \/>\nthe request takes the form of a nondiscretionary directive and is within<br \/>\nthe authority of the agency official making the request.&#8221;;<br \/>\n(4) in subsection (b), by striking the heading and inserting<br \/>\n&#8220;Agency Employees.&#8211;&#8221;; and<br \/>\n(5) in subsection (e), as redesignated by paragraph (2), by<br \/>\ninserting &#8220;contractor employee,&#8221; after &#8220;any employee,&#8221;.<\/p>\n<p>(b) &lt;&lt;NOTE: 5 USC 2303 note.&gt;&gt; Federal Bureau of Investigation.&#8211;<br \/>\n(1) In general.&#8211;Any employee of a contractor,<br \/>\nsubcontractor, grantee, subgrantee, or personal services<br \/>\ncontractor, of the Federal Bureau of Investigation who has<br \/>\nauthority to take, direct others to take, recommend, or approve<br \/>\nany personnel action, shall not, with respect to such authority,<br \/>\ntake or fail to take a personnel action with respect to a<br \/>\ncontractor employee as a reprisal for a disclosure of<br \/>\ninformation&#8211;<br \/>\n(A) made&#8211;<br \/>\n(i) to a supervisor in the direct chain of<br \/>\ncommand of the contractor employee;<br \/>\n(ii) to the Inspector General;<br \/>\n(iii) to the Office of Professional<br \/>\nResponsibility of the Department of Justice;<br \/>\n(iv) to the Office of Professional<br \/>\nResponsibility of the Federal Bureau of<br \/>\nInvestigation;<br \/>\n(v) to the Inspection Division of the Federal<br \/>\nBureau of Investigation;<br \/>\n(vi) to the Office of Special Counsel; or<br \/>\n(vii) to an employee designated by any<br \/>\nofficer, employee, office, or division described<br \/>\nin clauses (i) through (vii) for the purpose of<br \/>\nreceiving such disclosures; and<\/p>\n<p>[[Page 132 STAT. 17]]<\/p>\n<p>(B) which the contractor employee reasonably<br \/>\nbelieves evidences&#8211;<br \/>\n(i) any violation of any law, rule, or<br \/>\nregulation (including with respect to evidence of<br \/>\nanother employee or contractor employee accessing<br \/>\nor sharing classified information without<br \/>\nauthorization); or<br \/>\n(ii) gross mismanagement, a gross waste of<br \/>\nfunds, an abuse of authority, or a substantial and<br \/>\nspecific danger to public health or safety.<br \/>\n(2) Actions by request.&#8211;A personnel action under paragraph<br \/>\n(1) is prohibited even if the action is undertaken at the<br \/>\nrequest of an official of the Federal Bureau of Investigation,<br \/>\nunless the request takes the form of a nondiscretionary<br \/>\ndirective and is within the authority of the official making the<br \/>\nrequest.<br \/>\n(3) Regulations.&#8211;The Attorney General shall prescribe<br \/>\nregulations to ensure that a personnel action described in<br \/>\nparagraph (1) shall not be taken against a contractor employee<br \/>\nof the Federal Bureau of Investigation as a reprisal for any<br \/>\ndisclosure of information described in subparagraph (A) of such<br \/>\nparagraph.<br \/>\n(4) &lt;&lt;NOTE: President.&gt;&gt; Enforcement.&#8211;The President shall<br \/>\nprovide for the enforcement of this subsection.<br \/>\n(5) Definitions.&#8211;In this subsection:<br \/>\n(A) The term &#8220;contractor employee&#8221; means an<br \/>\nemployee of a contractor, subcontractor, grantee,<br \/>\nsubgrantee, or personal services contractor, of the<br \/>\nFederal Bureau of Investigation.<br \/>\n(B) The term &#8220;personnel action&#8221; means any action<br \/>\ndescribed in clauses (i) through (x) of section<br \/>\n2302(a)(2)(A) of title 5, United States Code, with<br \/>\nrespect to a contractor employee.<\/p>\n<p>(c) Retaliatory Revocation of Security Clearances and Access<br \/>\nDeterminations.&#8211;Section 3001(j) of the Intelligence Reform and<br \/>\nTerrorism Prevention Act of 2004 (50 U.S.C. 3341(j)) is amended by<br \/>\nadding at the end the following new paragraph:<br \/>\n&#8220;(8) Inclusion of contractor employees.&#8211;In this<br \/>\nsubsection, the term `employee&#8217; includes an employee of a<br \/>\ncontractor, subcontractor, grantee, subgrantee, or personal<br \/>\nservices contractor, of an agency. With respect to such<br \/>\nemployees, the term `employing agency&#8217; shall be deemed to be the<br \/>\ncontracting agency.&#8221;.<br \/>\nSEC. 111. &lt;&lt;NOTE: Deadline. Consultation.&gt;&gt; BRIEFING ON<br \/>\nNOTIFICATION REQUIREMENTS.<\/p>\n<p>Not later than 180 days after the date of the enactment of this Act,<br \/>\nthe Attorney General, in consultation with the Director of National<br \/>\nIntelligence, shall provide to the Committee on the Judiciary and the<br \/>\nPermanent Select Committee on Intelligence of the House of<br \/>\nRepresentatives and the Committee on the Judiciary and the Select<br \/>\nCommittee on Intelligence of the Senate a briefing with respect to how<br \/>\nthe Department of Justice interprets the requirements under sections<br \/>\n106(c), 305(d), and 405(c) of the Foreign Intelligence Surveillance Act<br \/>\nof 1978 (50 U.S.C. 1806(c), 1825(d), and 1845(c)) to notify an aggrieved<br \/>\nperson under such sections of the use of information obtained or derived<br \/>\nfrom electronic surveillance, physical search, or the use of a pen<br \/>\nregister or trap and trace device. The briefing shall focus on how the<br \/>\nDepartment interprets the phrase &#8220;obtained or derived from&#8221; in such<br \/>\nsections.<\/p>\n<p>[[Page 132 STAT. 18]]<\/p>\n<p>SEC. 112. INSPECTOR GENERAL REPORT ON QUERIES CONDUCTED BY FEDERAL<br \/>\nBUREAU OF INVESTIGATION.<\/p>\n<p>(a) Report.&#8211;Not later than 1 year after the date on which the<br \/>\nForeign Intelligence Surveillance Court first approves the querying<br \/>\nprocedures adopted pursuant to section 702(f) of the Foreign<br \/>\nIntelligence Surveillance Act of 1978 (50 U.S.C. 1881a(f)), as added by<br \/>\nsection 101, the Inspector General of the Department of Justice shall<br \/>\nsubmit to the Committee on the Judiciary and the Select Committee on<br \/>\nIntelligence of the Senate and the Committee on the Judiciary and the<br \/>\nPermanent Select Committee on Intelligence of the House of<br \/>\nRepresentatives a report containing a review by the Inspector General of<br \/>\nthe interpretation of, and compliance with, such procedures by the<br \/>\nFederal Bureau of Investigation.<br \/>\n(b) Matters Included.&#8211;The report under subsection (a) shall<br \/>\ninclude, at a minimum, an assessment of the following:<br \/>\n(1) The interpretations by the Federal Bureau of<br \/>\nInvestigation and the National Security Division of the<br \/>\nDepartment of Justice, respectively, relating to the querying<br \/>\nprocedures adopted under subsection (f) of section 702 of the<br \/>\nForeign Intelligence Surveillance Act of 1978 (50 U.S.C.<br \/>\n1881a(f)), as added by section 101.<br \/>\n(2) The handling by the Federal Bureau of Investigation of<br \/>\nindividuals whose citizenship status is unknown at the time of a<br \/>\nquery conducted under such section 702.<br \/>\n(3) The practice of the Federal Bureau of Investigation with<br \/>\nrespect to retaining records of queries conducted under such<br \/>\nsection 702 for auditing purposes.<br \/>\n(4) The training or other processes of the Federal Bureau of<br \/>\nInvestigation to ensure compliance with such querying<br \/>\nprocedures.<br \/>\n(5) The implementation of such querying procedures with<br \/>\nrespect to queries conducted when evaluating whether to open an<br \/>\nassessment or predicated investigation relating to the national<br \/>\nsecurity of the United States.<br \/>\n(6) The scope of access by the criminal division of the<br \/>\nFederal Bureau of Investigation to information obtained pursuant<br \/>\nto the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.<br \/>\n1801 et seq.), including with respect to information acquired<br \/>\nunder subsection (a) of such section 702 based on queries<br \/>\nconducted by the criminal division.<br \/>\n(7) The frequency and nature of the reviews conducted by the<br \/>\nNational Security Division of the Department of Justice and the<br \/>\nOffice of the Director of National Intelligence relating to the<br \/>\ncompliance by the Federal Bureau of Investigation with such<br \/>\nquerying procedures.<br \/>\n(8) Any impediments, including operational, technical, or<br \/>\npolicy impediments, for the Federal Bureau of Investigation to<br \/>\ncount&#8211;<br \/>\n(A) the total number of queries where the Federal<br \/>\nBureau of Investigation subsequently accessed<br \/>\ninformation acquired under subsection (a) of such<br \/>\nsection 702;<br \/>\n(B) the total number of such queries that used known<br \/>\nUnited States person identifiers; and<br \/>\n(C) the total number of queries for which the<br \/>\nFederal Bureau of Investigation received an order of the<br \/>\nForeign<\/p>\n<p>[[Page 132 STAT. 19]]<\/p>\n<p>Intelligence Surveillance Court pursuant to subsection<br \/>\n(f)(2) of such section 702.<\/p>\n<p>(c) Form.&#8211;The report under subsection (a) shall be submitted in<br \/>\nunclassified form to the extent consistent with national security, but<br \/>\nmay include a classified annex.<\/p>\n<p>TITLE II&#8211;EXTENSION OF AUTHORITIES, INCREASED PENALTIES, REPORTS, AND<br \/>\nOTHER MATTERS<\/p>\n<p>SEC. 201. EXTENSION OF TITLE VII OF FISA; EFFECTIVE DATES.<\/p>\n<p>(a) Extension.&#8211;Section 403(b) of the FISA Amendments Act of 2008<br \/>\n(Public Law 110-261; 122 Stat. 2474) is amended&#8211;<br \/>\n(1) &lt;&lt;NOTE: 50 USC 1881 and note, 1881a-1881g.&gt;&gt; in<br \/>\nparagraph (1)&#8211;<br \/>\n(A) by striking &#8220;December 31, 2017&#8221; and inserting<br \/>\n&#8220;December 31, 2023&#8221;; and<br \/>\n(B) by inserting &#8220;and by the FISA Amendments<br \/>\nReauthorization Act of 2017&#8221; after &#8220;section 101(a)&#8221;;<br \/>\nand<br \/>\n(2) &lt;&lt;NOTE: 50 USC 2511 note.&gt;&gt; in paragraph (2) in the<br \/>\nmatter preceding subparagraph (A), by striking &#8220;December 31,<br \/>\n2017&#8221; and inserting &#8220;December 31, 2023&#8221;.<\/p>\n<p>(b) Conforming Amendments.&#8211;Section 404(b) of the FISA Amendments<br \/>\nAct of 2008 (Public Law 110-261; 122 Stat. 2476), as amended by section<br \/>\n101, &lt;&lt;NOTE: 50 USC 1801 note.&gt;&gt; is further amended&#8211;<br \/>\n(1) in paragraph (1)&#8211;<br \/>\n(A) in the heading, by striking &#8220;December 31,<br \/>\n2017&#8221; and inserting &#8220;December 31, 2023&#8221;; and<br \/>\n(B) by inserting &#8220;and by the FISA Amendments<br \/>\nReauthorization Act of 2017&#8221; after &#8220;section 101(a)&#8221;;<br \/>\n(2) in paragraph (2), by inserting &#8220;and by the FISA<br \/>\nAmendments Reauthorization Act of 2017&#8221; after &#8220;section<br \/>\n101(a)&#8221;; and<br \/>\n(3) in paragraph (4)&#8211;<br \/>\n(A) by inserting &#8220;and amended by the FISA<br \/>\nAmendments Reauthorization Act of 2017&#8221; after &#8220;as<br \/>\nadded by section 101(a)&#8221; both places it appears; and<br \/>\n(B) by inserting &#8220;and by the FISA Amendments<br \/>\nReauthorization Act of 2017&#8221; after &#8220;as amended by<br \/>\nsection 101(a)&#8221; both places it appears.<\/p>\n<p>(c) &lt;&lt;NOTE: 50 USC 1881 note.&gt;&gt; Effective Date of Amendments to<br \/>\nFAA.&#8211;The amendments made to the FISA Amendments Act of 2008 (Public Law<br \/>\n110-261) by this section shall take effect on December 31, 2017.<br \/>\nSEC. 202. INCREASED PENALTY FOR UNAUTHORIZED REMOVAL AND RETENTION<br \/>\nOF CLASSIFIED DOCUMENTS OR MATERIAL.<\/p>\n<p>Section 1924(a) of title 18, United States Code, is amended by<br \/>\nstriking &#8220;one year&#8221; and inserting &#8220;five years&#8221;.<br \/>\nSEC. 203. REPORT ON CHALLENGES TO THE EFFECTIVENESS OF FOREIGN<br \/>\nINTELLIGENCE SURVEILLANCE.<\/p>\n<p>(a) &lt;&lt;NOTE: Coordination.&gt;&gt; Report.&#8211;Not later than 270 days after<br \/>\nthe date of the enactment of this Act, the Attorney General, in<br \/>\ncoordination with the Director of National Intelligence, shall submit to<br \/>\nthe Committee on the Judiciary and the Permanent Select Committee on<br \/>\nIntelligence of the House of Representatives and the Committee on the<br \/>\nJudiciary and the Select Committee on Intelligence of the Senate<\/p>\n<p>[[Page 132 STAT. 20]]<\/p>\n<p>a report on current and future challenges to the effectiveness of the<br \/>\nforeign intelligence surveillance activities of the United States<br \/>\nauthorized under the Foreign Intelligence Surveillance Act of 1978 (50<br \/>\nU.S.C. 1801 et seq.).<\/p>\n<p>(b) &lt;&lt;NOTE: Recommenda- tions.&gt;&gt; Matters Included.&#8211;The report<br \/>\nunder subsection (a) shall include, at a minimum, the following:<\/p>\n<p>(1) A discussion of any trends that currently challenge the<br \/>\neffectiveness of the foreign intelligence surveillance activities of the<br \/>\nUnited States, or could foreseeably challenge such activities during the<br \/>\ndecade following the date of the report, including with respect to&#8211;<br \/>\n(A) the extraordinary and surging volume of data<br \/>\noccurring worldwide;<br \/>\n(B) the use of encryption;<br \/>\n(C) changes to worldwide telecommunications patterns<br \/>\nor infrastructure;<br \/>\n(D) technical obstacles in determining the location<br \/>\nof data or persons;<br \/>\n(E) the increasing complexity of the legal regime,<br \/>\nincluding regarding requests for data in the custody of<br \/>\nforeign governments;<br \/>\n(F) the current and future ability of the United<br \/>\nStates to obtain, on a compulsory or voluntary basis,<br \/>\nassistance from telecommunications providers or other<br \/>\nentities; and<br \/>\n(G) any other matters the Attorney General and the<br \/>\nDirector of National Intelligence determine appropriate.<br \/>\n(2) Recommendations for changes, including, as appropriate,<br \/>\nfundamental changes, to the foreign intelligence surveillance<br \/>\nactivities of the United States to address the challenges<br \/>\nidentified under paragraph (1) and to ensure the long-term<br \/>\neffectiveness of such activities.<br \/>\n(3) Recommendations for any changes to the Foreign<br \/>\nIntelligence Surveillance Act of 1978 (50 U.S.C. 1801 et seq.)<br \/>\nthat the Attorney General and the Director of National<br \/>\nIntelligence determine necessary to address the challenges<br \/>\nidentified under paragraph (1).<\/p>\n<p>(c) Form.&#8211;The report under subsection (a) may be submitted in<br \/>\nclassified or unclassified form.<br \/>\nSEC. 204. COMPTROLLER GENERAL STUDY ON THE CLASSIFICATION SYSTEM<br \/>\nAND PROTECTION OF CLASSIFIED INFORMATION.<\/p>\n<p>(a) Study.&#8211;The Comptroller General of the United States shall<br \/>\nconduct a study of the classification system of the United States and<br \/>\nthe methods by which the intelligence community (as defined in section<br \/>\n3(4) of the National Security Act of 1947 (50 U.S.C. 3003(4))) protects<br \/>\nclassified information.<br \/>\n(b) Matters Included.&#8211;The study under subsection (a) shall address<br \/>\nthe following:<br \/>\n(1) Whether sensitive information is properly classified.<br \/>\n(2) The effect of modern technology on the storage and<br \/>\nprotection of classified information, including with respect<br \/>\nto&#8211;<br \/>\n(A) using cloud storage for classified information;<br \/>\nand<br \/>\n(B) any technological means to prevent or detect<br \/>\nunauthorized access to such information.<br \/>\n(3) Any ways to improve the classification system of the<br \/>\nUnited States, including with respect to changing the levels<\/p>\n<p>[[Page 132 STAT. 21]]<\/p>\n<p>of classification used in such system and to reduce<br \/>\noverclassification.<br \/>\n(4) How to improve the authorized sharing of classified<br \/>\ninformation, including with respect to sensitive compartmented<br \/>\ninformation.<br \/>\n(5) The value of polygraph tests in determining who is<br \/>\nauthorized to access classified information and in investigating<br \/>\nunauthorized disclosures of classified information.<br \/>\n(6) Whether each element of the intelligence community&#8211;<br \/>\n(A) applies uniform standards in determining who is<br \/>\nauthorized to access classified information; and<br \/>\n(B) provides proper training with respect to the<br \/>\nhandling of classified information and the avoidance of<br \/>\noverclassification.<\/p>\n<p>(c) Report.&#8211;Not later than 180 days after the date of the enactment<br \/>\nof this Act, the Comptroller General shall submit to the Committee on<br \/>\nthe Judiciary and the Permanent Select Committee on Intelligence of the<br \/>\nHouse of Representatives and the Committee on the Judiciary and the<br \/>\nSelect Committee on Intelligence of the Senate a report containing the<br \/>\nstudy under subsection (a).<br \/>\n(d) Form.&#8211;The report under subsection (c) shall be submitted in<br \/>\nunclassified form, but may include a classified annex.<br \/>\nSEC. 205. TECHNICAL AMENDMENTS AND AMENDMENTS TO IMPROVE<br \/>\nPROCEDURES OF THE FOREIGN INTELLIGENCE<br \/>\nSURVEILLANCE COURT OF REVIEW.<\/p>\n<p>(a) Technical Amendments.&#8211;The Foreign Intelligence Surveillance Act<br \/>\nof 1978 (50 U.S.C. 1801 et seq.) is amended as follows:<br \/>\n(1) In section 103(b) (50 U.S.C. 1803(b)), by striking<br \/>\n&#8220;designate as the&#8221; and inserting &#8220;designated as the&#8221;.<br \/>\n(2) In section 302(a)(1)(A)(iii) (50 U.S.C.<br \/>\n1822(a)(1)(A)(iii)), by striking &#8220;paragraphs (1) through (4)&#8221;<br \/>\nand inserting &#8220;subparagraphs (A) through (D)&#8221;.<br \/>\n(3) In section 406(b) (50 U.S.C. 1846(b)), by striking &#8220;and<br \/>\nto the Committees on the Judiciary of the House of<br \/>\nRepresentatives and the Senate&#8221;.<br \/>\n(4) In section 604(a) (50 U.S.C. 1874(a))&#8211;<br \/>\n(A) in paragraph (1)(D), by striking &#8220;contents&#8221;<br \/>\nand inserting &#8220;contents,&#8221;; and<br \/>\n(B) in paragraph (3), by striking &#8220;comply in the<br \/>\ninto&#8221; and inserting &#8220;comply into&#8221;.<br \/>\n(5) In section 701 (50 U.S.C. 1881)&#8211;<br \/>\n(A) in subsection (a), by striking &#8220;The terms&#8221; and<br \/>\ninserting &#8220;In this title, the terms&#8221;; and<br \/>\n(B) in subsection (b)&#8211;<br \/>\n(i) by inserting &#8220;In this title:&#8221; after the<br \/>\nsubsection heading; and<br \/>\n(ii) in paragraph (5), by striking &#8220;(50<br \/>\nU.S.C. 401a(4))&#8221; and inserting &#8220;(50 U.S.C.<br \/>\n3003(4))&#8221;.<br \/>\n(6) In section 702(h)(2)(A)(i) (50 U.S.C.<br \/>\n1881a(h)(2)(A)(i)), as redesignated by section 101, by inserting<br \/>\n&#8220;targeting&#8221; before &#8220;procedures in place&#8221;.<br \/>\n(7) In section 801(7) (50 U.S.C. 1885(7)), by striking &#8220;(50<br \/>\nU.S.C. 401a(4))&#8221; and inserting &#8220;(50 U.S.C. 3003(4))&#8221;.<\/p>\n<p>[[Page 132 STAT. 22]]<\/p>\n<p>(b) Court-related Amendments.&#8211;The Foreign Intelligence Surveillance<br \/>\nAct of 1978 (50 U.S.C. 1801 et seq.) is further amended as follows:<br \/>\n(1) In section 103 (50 U.S.C. 1803)&#8211;<br \/>\n(A) in subsection (b), by striking &#8220;immediately&#8221;;<br \/>\nand<br \/>\n(B) in subsection (h), by striking &#8220;the court<br \/>\nestablished under subsection (a)&#8221; and inserting &#8220;a<br \/>\ncourt established under this section&#8221;.<br \/>\n(2) In section 105(d) (50 U.S.C. 1805(d)), by adding at the<br \/>\nend the following new paragraph:<\/p>\n<p>&#8220;(4) A denial of the application made under section 104 may be<br \/>\nreviewed as provided in section 103.&#8221;.<br \/>\n(3) In section 302(d) (50 U.S.C. 1822(d)), by striking<br \/>\n&#8220;immediately&#8221;.<br \/>\n(4) In section 402(d) (50 U.S.C. 1842(d)), by adding at the<br \/>\nend the following new paragraph:<\/p>\n<p>&#8220;(3) A denial of the application made under this subsection may be<br \/>\nreviewed as provided in section 103.&#8221;.<br \/>\n(5) In section 403(c) (50 U.S.C. 1843(c)), by adding at the<br \/>\nend the following new paragraph:<\/p>\n<p>&#8220;(3) A denial of the application made under subsection (a)(2) may<br \/>\nbe reviewed as provided in section 103.&#8221;.<br \/>\n(6) In section 501(c) (50 U.S.C. 1861(c)), by adding at the<br \/>\nend the following new paragraph:<br \/>\n&#8220;(4) A denial of the application made under this subsection<br \/>\nmay be reviewed as provided in section 103.&#8221;.<br \/>\nSEC. 206. &lt;&lt;NOTE: 50 USC 1801 note.&gt;&gt; SEVERABILITY.<\/p>\n<p>If any provision of this Act, any amendment made by this Act, or the<br \/>\napplication thereof to any person or circumstances is held invalid, the<br \/>\nvalidity of the remainder of the Act, of any such amendments, and of the<br \/>\napplication of such provisions to other persons and circumstances shall<br \/>\nnot be affected thereby.<\/p>\n<p>Approved January 19, 2018.<\/p>\n<p>LEGISLATIVE HISTORY&#8211;S. 139:<br \/>\n&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>CONGRESSIONAL RECORD:<br \/>\nVol. 163 (2017):<br \/>\nMay 16, considered and passed<br \/>\nSenate.<br \/>\nVol. 164 (2018):<br \/>\nJan. 11, considered and passed<br \/>\nHouse, amended.
