SHORT TITLE.<\/p>\n<p>This Act may be cited as the &#8220;Recognize, Assist, Include, Support,<br \/>\nand Engage Family Caregivers Act of 2017&#8221; or the &#8220;RAISE Family<br \/>\nCaregivers Act&#8221;.<br \/>\nSEC. 2. DEFINITIONS.<\/p>\n<p>In this Act:<br \/>\n(1) Advisory council.&#8211;The term &#8220;Advisory Council&#8221; means<br \/>\nthe Family Caregiving Advisory Council convened under section 4.<br \/>\n(2) Family caregiver.&#8211;The term &#8220;family caregiver&#8221; means<br \/>\nan adult family member or other individual who has a significant<br \/>\nrelationship with, and who provides a broad range of assistance<br \/>\nto, an individual with a chronic or other health condition,<br \/>\ndisability, or functional limitation.<br \/>\n(3) Secretary.&#8211;The term &#8220;Secretary&#8221; means the Secretary<br \/>\nof Health and Human Services.<br \/>\n(4) Strategy.&#8211;The term &#8220;Strategy&#8221; means the Family<br \/>\nCaregiving Strategy set forth under section 3.<br \/>\nSEC. 3. FAMILY CAREGIVING STRATEGY.<\/p>\n<p>(a) &lt;&lt;NOTE: Consultation. Public information. Web posting.&gt;&gt; In<br \/>\nGeneral.&#8211;The Secretary, in consultation with the heads of other<br \/>\nappropriate Federal agencies, shall develop jointly with the Advisory<br \/>\nCouncil and submit to the Committee on Health, Education, Labor, and<br \/>\nPensions and the Special Committee on Aging of the Senate, the Committee<br \/>\non Education and the Workforce of the House of Representatives, and the<br \/>\nState agencies responsible for carrying out family caregiver programs,<br \/>\nand make publicly available on the internet website of the Department of<br \/>\nHealth and Human Services, a Family Caregiving Strategy.<\/p>\n<p>(b) Contents.&#8211;The Strategy shall identify recommended actions that<br \/>\nFederal (under existing Federal programs), State, and local governments,<br \/>\ncommunities, health care providers, long-term services and supports<br \/>\nproviders, and others are taking, or may take, to recognize and support<br \/>\nfamily caregivers in a manner that reflects their diverse needs,<br \/>\nincluding with respect to the following:<br \/>\n(1) Promoting greater adoption of person- and family-<br \/>\ncentered care in all health and long-term services and supports<br \/>\nsettings, with the person receiving services and supports and<\/p>\n<p>[[Page 132 STAT. 24]]<\/p>\n<p>the family caregiver (as appropriate) at the center of care<br \/>\nteams.<br \/>\n(2) Assessment and service planning (including care<br \/>\ntransitions and coordination) involving family caregivers and<br \/>\ncare recipients.<br \/>\n(3) Information, education and training supports, referral,<br \/>\nand care coordination, including with respect to hospice care,<br \/>\npalliative care, and advance planning services.<br \/>\n(4) Respite options.<br \/>\n(5) Financial security and workplace issues.<br \/>\n(6) Delivering services based on the performance, mission,<br \/>\nand purpose of a program while eliminating redundancies.<\/p>\n<p>(c) Duties of the Secretary.&#8211;The Secretary, in carrying out<br \/>\nsubsection (a), shall oversee the following:<br \/>\n(1) Collecting and making publicly available information<br \/>\nsubmitted by the Advisory Council under section 4(d) to the<br \/>\nCommittee on Health, Education, Labor, and Pensions and the<br \/>\nSpecial Committee on Aging of the Senate, the Committee on<br \/>\nEducation and the Workforce of the House of Representatives, and<br \/>\nthe State agencies responsible for carrying out family caregiver<br \/>\nprograms, including evidence-based or promising practices and<br \/>\ninnovative models (both domestic and foreign) regarding the<br \/>\nprovision of care by family caregivers or support for family<br \/>\ncaregivers.<br \/>\n(2) Coordinating and assessing existing Federal Government<br \/>\nprograms and activities to recognize and support family<br \/>\ncaregivers while ensuring maximum effectiveness and avoiding<br \/>\nunnecessary duplication.<br \/>\n(3) Providing technical assistance, as appropriate, such as<br \/>\ndisseminating identified best practices and information sharing<br \/>\nbased on reports provided under section 4(d), to State or local<br \/>\nefforts to support family caregivers.<\/p>\n<p>(d) &lt;&lt;NOTE: Publications.&gt;&gt; Initial Strategy; Updates.&#8211;The<br \/>\nSecretary shall&#8211;<br \/>\n(1) &lt;&lt;NOTE: Deadline.&gt;&gt; not later than 18 months after the<br \/>\ndate of enactment of this Act, develop, publish, and submit to<br \/>\nthe Committee on Health, Education, Labor, and Pensions and the<br \/>\nSpecial Committee on Aging of the Senate, the Committee on<br \/>\nEducation and the Workforce of the House of Representatives, and<br \/>\nthe State agencies responsible for carrying out family caregiver<br \/>\nprograms, an initial Strategy incorporating the items addressed<br \/>\nin the Advisory Council&#8217;s initial report under section 4(d) and<br \/>\nother relevant information, including best practices, for<br \/>\nrecognizing and supporting family caregivers; and<br \/>\n(2) biennially update, republish, and submit to the<br \/>\nCommittee on Health, Education, Labor, and Pensions and the<br \/>\nSpecial Committee on Aging of the Senate, the Committee on<br \/>\nEducation and the Workforce of the House of Representatives, and<br \/>\nthe State agencies responsible for carrying out family caregiver<br \/>\nprograms the Strategy, taking into account the most recent<br \/>\nannual report submitted under section 4(d)(1)&#8211;<br \/>\n(A) to reflect new developments, challenges,<br \/>\nopportunities, and solutions; and<br \/>\n(B) to review progress based on recommendations for<br \/>\nrecognizing and supporting family caregivers in the<br \/>\nStrategy and, based on the results of such review,<br \/>\nrecommend priority actions for improving the<br \/>\nimplementation of such recommendations, as appropriate.<\/p>\n<p>[[Page 132 STAT. 25]]<\/p>\n<p>(e) &lt;&lt;NOTE: Recommenda- tions.&gt;&gt; Process for Public Input.&#8211;The<br \/>\nSecretary shall establish a process for public input to inform the<br \/>\ndevelopment of, and updates to, the Strategy, including a process for<br \/>\nthe public to submit recommendations to the Advisory Council and an<br \/>\nopportunity for public comment on the proposed Strategy.<\/p>\n<p>(f) No Preemption.&#8211;Nothing in this Act preempts any authority of a<br \/>\nState or local government to recognize or support family caregivers.<br \/>\n(g) Rule of Construction.&#8211;Nothing in this Act shall be construed to<br \/>\npermit the Secretary (through regulation, guidance, grant criteria, or<br \/>\notherwise) to&#8211;<br \/>\n(1) mandate, direct, or control the allocation of State or<br \/>\nlocal resources;<br \/>\n(2) mandate the use of any of the best practices identified<br \/>\nin the reports required under this Act; or<br \/>\n(3) otherwise expand the authority of the Secretary beyond<br \/>\nthat expressly provided to the Secretary in this Act.<br \/>\nSEC. 4. FAMILY CAREGIVING ADVISORY COUNCIL.<\/p>\n<p>(a) &lt;&lt;NOTE: Recommenda- tions.&gt;&gt; Convening.&#8211;The Secretary shall<br \/>\nconvene a Family Caregiving Advisory Council to advise and provide<br \/>\nrecommendations, including identified best practices, to the Secretary<br \/>\non recognizing and supporting family caregivers.<\/p>\n<p>(b) Membership.&#8211;<br \/>\n(1) In general.&#8211;The members of the Advisory Council shall<br \/>\nconsist of&#8211;<br \/>\n(A) the appointed members under paragraph (2); and<br \/>\n(B) the Federal members under paragraph (3).<br \/>\n(2) Appointed members.&#8211;In addition to the Federal members<br \/>\nunder paragraph (3), the Secretary shall appoint not more than<br \/>\n15 voting members of the Advisory Council who are not<br \/>\nrepresentatives of Federal departments or agencies and who shall<br \/>\ninclude at least 1 representative of each of the following:<br \/>\n(A) Family caregivers.<br \/>\n(B) Older adults with long-term services and<br \/>\nsupports needs.<br \/>\n(C) Individuals with disabilities.<br \/>\n(D) Health care and social service providers.<br \/>\n(E) Long-term services and supports providers.<br \/>\n(F) Employers.<br \/>\n(G) Paraprofessional workers.<br \/>\n(H) State and local officials.<br \/>\n(I) Accreditation bodies.<br \/>\n(J) Veterans.<br \/>\n(K) As appropriate, other experts and advocacy<br \/>\norganizations engaged in family caregiving.<br \/>\n(3) Federal members.&#8211;The Federal members of the Advisory<br \/>\nCouncil, who shall be nonvoting members, shall consist of the<br \/>\nfollowing:<br \/>\n(A) The Administrator of the Centers for Medicare &amp;<br \/>\nMedicaid Services (or the Administrator&#8217;s designee).<br \/>\n(B) The Administrator of the Administration for<br \/>\nCommunity Living (or the Administrator&#8217;s designee who<br \/>\nhas experience in both aging and disability).<br \/>\n(C) The Secretary of Veterans Affairs (or the<br \/>\nSecretary&#8217;s designee).<\/p>\n<p>[[Page 132 STAT. 26]]<\/p>\n<p>(D) The heads of other Federal departments or<br \/>\nagencies (or their designees), including relevant<br \/>\ndepartments or agencies that oversee labor and<br \/>\nworkforce, economic, government financial policies,<br \/>\ncommunity service, and other impacted populations, as<br \/>\nappointed by the Secretary or the Chair of the Advisory<br \/>\nCouncil.<br \/>\n(4) Diverse representation.&#8211;The Secretary shall ensure that<br \/>\nthe membership of the Advisory Council reflects the diversity of<br \/>\nfamily caregivers and individuals receiving services and<br \/>\nsupports.<\/p>\n<p>(c) &lt;&lt;NOTE: Time period. Public information.&gt;&gt; Meetings.&#8211;The<br \/>\nAdvisory Council shall meet quarterly during the 1-year period beginning<br \/>\non the date of enactment of this Act and at least three times during<br \/>\neach year thereafter. Meetings of the Advisory Council shall be open to<br \/>\nthe public.<\/p>\n<p>(d) Advisory Council Annual Reports.&#8211;<br \/>\n(1) &lt;&lt;NOTE: Public information. Web posting.&gt;&gt; In<br \/>\ngeneral.&#8211;Not later than 12 months after the date of enactment<br \/>\nof this Act, and annually thereafter, the Advisory Council shall<br \/>\nsubmit to the Secretary, the Committee on Health, Education,<br \/>\nLabor, and Pensions and the Special Committee on Aging of the<br \/>\nSenate, the Committee on Education and the Workforce of the<br \/>\nHouse of Representatives, and the State agencies responsible for<br \/>\ncarrying out family caregiver programs, and make publicly<br \/>\navailable on the internet website of the Department of Health<br \/>\nand Human Services, a report concerning the development,<br \/>\nmaintenance, and updating of the Strategy, including a<br \/>\ndescription of the outcomes of the recommendations and any<br \/>\npriorities included in the initial report pursuant to paragraph<br \/>\n(2), as appropriate.<br \/>\n(2) Initial report.&#8211;The Advisory Council&#8217;s initial report<br \/>\nunder paragraph (1) shall include&#8211;<br \/>\n(A) &lt;&lt;NOTE: Records. Assessment.&gt;&gt; an inventory and<br \/>\nassessment of all federally funded efforts to recognize<br \/>\nand support family caregivers and the outcomes of such<br \/>\nefforts, including analyses of the extent to which<br \/>\nfederally funded efforts are reaching family caregivers<br \/>\nand gaps in such efforts;<br \/>\n(B) &lt;&lt;NOTE: Recommenda- tions.&gt;&gt; recommendations&#8211;<br \/>\n(i) to improve and better coordinate Federal<br \/>\nprograms and activities to recognize and support<br \/>\nfamily caregivers, as well as opportunities to<br \/>\nimprove the coordination of such Federal programs<br \/>\nand activities with State programs; and<br \/>\n(ii) to effectively deliver services based on<br \/>\nthe performance, mission, and purpose of a program<br \/>\nwhile eliminating redundancies, avoiding<br \/>\nunnecessary duplication and overlap, and ensuring<br \/>\nthe needs of family caregivers are met;<br \/>\n(C) the identification of challenges faced by family<br \/>\ncaregivers, including financial, health, and other<br \/>\nchallenges, and existing approaches to address such<br \/>\nchallenges; and<br \/>\n(D) &lt;&lt;NOTE: Evaluation.&gt;&gt; an evaluation of how<br \/>\nfamily caregiving impacts the Medicare program, the<br \/>\nMedicaid program, and other Federal programs.<\/p>\n<p>(e) Nonapplicability of FACA.&#8211;The Federal Advisory Committee Act (5<br \/>\nU.S.C. App.) shall not apply to the Advisory Council.<\/p>\n<p>[[Page 132 STAT. 27]]<\/p>\n<p>SEC. 5. FUNDING.<\/p>\n<p>No additional funds are authorized to be appropriated to carry out<br \/>\nthis Act. This Act shall be carried out using funds otherwise<br \/>\nauthorized.<br \/>\nSEC. 6.
