SHORT TITLE; TABLE OF CONTENTS.<\/p>\n<p>(a) &lt;&lt;NOTE: 36 USC 101 note.&gt;&gt; Short Title.&#8211;This Act may be cited<br \/>\nas the &#8220;Protecting Young Victims from Sexual Abuse and Safe Sport<br \/>\nAuthorization Act of 2017&#8221;.<\/p>\n<p>(b) Table of Contents.&#8211;The table of contents of this Act is as<br \/>\nfollows:<\/p>\n<p>Sec. 1. Short title; table of contents.<\/p>\n<p>TITLE I&#8211;PROTECTING YOUNG VICTIMS FROM SEXUAL ABUSE<\/p>\n<p>Sec. 101. Required reporting of child and sexual abuse.<br \/>\nSec. 102. General requirements for youth-serving amateur sports<br \/>\norganizations.<\/p>\n<p>TITLE I&#8211;PROTECTING YOUNG VICTIMS FROM SEXUAL ABUSE<\/p>\n<p>SEC. 101. REQUIRED REPORTING OF CHILD AND SEXUAL ABUSE.<\/p>\n<p>(a) Reporting Requirement.&#8211;Section 226 of the Victims of Child<br \/>\nAbuse Act of 1990 (34 U.S.C. 20341) is amended&#8211;<br \/>\n(1) in subsection (a)&#8211;<br \/>\n(A) by striking &#8220;A person who&#8221; and inserting the<br \/>\nfollowing:<br \/>\n&#8220;(1) Covered professionals.&#8211;A person who&#8221;; and<br \/>\n(B) by adding at the end the following:<br \/>\n&#8220;(2) Covered individuals.&#8211;A covered individual who learns<br \/>\nof facts that give reason to suspect that a child has suffered<br \/>\nan incident of child abuse, including sexual abuse, shall as<br \/>\nsoon as possible make a report of the suspected abuse to the<br \/>\nagency designated by the Attorney General under subsection<br \/>\n(d).&#8221;;<br \/>\n(2) in subsection (b), in the matter preceding paragraph<br \/>\n(1), by striking &#8220;subsection (a)&#8221; and inserting &#8220;subsection<br \/>\n(a)(1)&#8221;;<\/p>\n<p>[[Page 132 STAT. 319]]<\/p>\n<p>(3) in subsection (c)&#8211;<br \/>\n(A) in paragraph (7), by striking &#8220;and&#8221; at the<br \/>\nend;<br \/>\n(B) in paragraph (8), by striking the period at the<br \/>\nend and inserting a semicolon; and<br \/>\n(C) &lt;&lt;NOTE: Definitions.&gt;&gt; by adding at the end the<br \/>\nfollowing:<br \/>\n&#8220;(9) the term `covered individual&#8217; means an adult who is<br \/>\nauthorized, by a national governing body, a member of a national<br \/>\ngoverning body, or an amateur sports organization that<br \/>\nparticipates in interstate or international amateur athletic<br \/>\ncompetition, to interact with a minor or amateur athlete at an<br \/>\namateur sports organization facility or at any event sanctioned<br \/>\nby a national governing body, a member of a national governing<br \/>\nbody, or such an amateur sports organization;<br \/>\n&#8220;(10) the term `event&#8217; includes travel, lodging, practice,<br \/>\ncompetition, and health or medical treatment;<br \/>\n&#8220;(11) the terms `amateur athlete&#8217;, `amateur athletic<br \/>\ncompetition&#8217;, `amateur sports organization&#8217;, `international<br \/>\namateur athletic competition&#8217;, and `national governing body&#8217;<br \/>\nhave the meanings given the terms in section 220501(b) of title<br \/>\n36, United States Code; and<br \/>\n&#8220;(12) the term `as soon as possible&#8217; means within a 24-hour<br \/>\nperiod.&#8221;;<br \/>\n(4) in subsection (d), in the first sentence, by inserting<br \/>\n&#8220;and for all covered individuals&#8221; after &#8220;reside&#8221;;<br \/>\n(5) in subsection (f), in the first sentence&#8211;<br \/>\n(A) by striking &#8220;and on all&#8221; and inserting &#8220;on<br \/>\nall&#8221;; and<br \/>\n(B) by inserting &#8220;and for all covered<br \/>\nindividuals,&#8221; after &#8220;lands,&#8221;;<br \/>\n(6) in subsection (h), by inserting &#8220;and all covered<br \/>\nindividuals,&#8221; after &#8220;facilities,&#8221;; and<br \/>\n(7) by adding at the end the following:<\/p>\n<p>&#8220;(i) Rule of Construction.&#8211;Nothing in this section shall be<br \/>\nconstrued to require a victim of child abuse to self-report the<br \/>\nabuse.&#8221;.<br \/>\n(b) Penalty for Failure To Report.&#8211;Section 2258 of title 18, United<br \/>\nStates Code, is amended by inserting &#8220;or a covered individual as<br \/>\ndescribed in subsection (a)(2) of such section 226 who,&#8221; after<br \/>\n&#8220;facility,&#8221;.<br \/>\nSEC. 102. CIVIL REMEDY FOR PERSONAL INJURIES.<\/p>\n<p>Section 2255 of title 18, United States Code, is amended&#8211;<br \/>\n(1) by striking subsection (a) and inserting the following:<\/p>\n<p>&#8220;(a) In General.&#8211;Any person who, while a minor, was a victim of a<br \/>\nviolation of section 1589, 1590, 1591, 2241(c), 2242, 2243, 2251, 2251A,<br \/>\n2252, 2252A, 2260, 2421, 2422, or 2423 of this title and who suffers<br \/>\npersonal injury as a result of such violation, regardless of whether the<br \/>\ninjury occurred while such person was a minor, may sue in any<br \/>\nappropriate United States District Court and shall recover the actual<br \/>\ndamages such person sustains or liquidated damages in the amount of<br \/>\n$150,000, and the cost of the action, including reasonable attorney&#8217;s<br \/>\nfees and other litigation costs reasonably incurred. The court may also<br \/>\naward punitive damages and such other preliminary and equitable relief<br \/>\nas the court determines to be appropriate.&#8221;;<\/p>\n<p>[[Page 132 STAT. 320]]<\/p>\n<p>(2) &lt;&lt;NOTE: Deadlines.&gt;&gt; in subsection (b), by striking<br \/>\n&#8220;filed within&#8221; and all that follows through the end and<br \/>\ninserting the following: &#8220;filed&#8211;<br \/>\n&#8220;(1) not later than 10 years after the date on which the<br \/>\nplaintiff reasonably discovers the later of&#8211;<br \/>\n&#8220;(A) the violation that forms the basis for the<br \/>\nclaim; or<br \/>\n&#8220;(B) the injury that forms the basis for the claim;<br \/>\nor<br \/>\n&#8220;(2) not later than 10 years after the date on which the<br \/>\nvictim reaches 18 years of age.&#8221;; and<br \/>\n(3) by adding at the end the following:<\/p>\n<p>&#8220;(c) Venue; Service of Process.&#8211;<br \/>\n&#8220;(1) Venue.&#8211;Any action brought under subsection (a) may be<br \/>\nbrought in the district court of the United States that meets<br \/>\napplicable requirements relating to venue under section 1391 of<br \/>\ntitle 28.<br \/>\n&#8220;(2) Service of process.&#8211;In an action brought under<br \/>\nsubsection (a), process may be served in any district in which<br \/>\nthe defendant&#8211;<br \/>\n&#8220;(A) is an inhabitant; or<br \/>\n&#8220;(B) may be found.&#8221;.<\/p>\n<p>TITLE II&#8211;UNITED STATES CENTER FOR SAFE SPORT AUTHORIZATION<\/p>\n<p>SEC. 201. EXPANSION OF THE PURPOSES OF THE CORPORATION.<\/p>\n<p>Section 220503 of title 36, United States Code, is amended&#8211;<br \/>\n(1) in paragraph (13), by striking &#8220;; and&#8221; and inserting a<br \/>\nsemicolon;<br \/>\n(2) in paragraph (14), by striking the period at the end and<br \/>\ninserting &#8220;; and&#8221;; and<br \/>\n(3) by adding at the end the following:<br \/>\n&#8220;(15) to promote a safe environment in sports that is free<br \/>\nfrom abuse, including emotional, physical, and sexual abuse, of<br \/>\nany amateur athlete.&#8221;.<br \/>\nSEC. 202. DESIGNATION OF THE UNITED STATES CENTER FOR SAFE SPORT.<\/p>\n<p>(a) In General.&#8211;Chapter 2205 of title 36, United States Code, is<br \/>\namended by adding at the end the following:<\/p>\n<p>&#8220;Subchapter III &lt;&lt;NOTE: 36 USC 220541 prec.&gt;&gt; &#8211;United States Center<br \/>\nfor Safe Sport<br \/>\n&#8220;Sec. 220541. &lt;&lt;NOTE: 36 USC 220541.&gt;&gt; Designation of United<br \/>\nStates Center for Safe Sport<\/p>\n<p>&#8220;(a) In General.&#8211;The United States Center for Safe Sport shall&#8211;<br \/>\n&#8220;(1) serve as the independent national safe sport<br \/>\norganization and be recognized worldwide as the independent<br \/>\nnational safe sport organization for the United States;<br \/>\n&#8220;(2) exercise jurisdiction over the corporation, each<br \/>\nnational governing body, and each paralympic sports organization<br \/>\nwith regard to safeguarding amateur athletes against abuse,<br \/>\nincluding emotional, physical, and sexual abuse, in sports;<\/p>\n<p>[[Page 132 STAT. 321]]<\/p>\n<p>&#8220;(3) maintain an office for education and outreach that<br \/>\nshall develop training, oversight practices, policies, and<br \/>\nprocedures to prevent the abuse, including emotional, physical,<br \/>\nand sexual abuse, of amateur athletes participating in amateur<br \/>\nathletic activities through national governing bodies and<br \/>\nparalympic sports organizations;<br \/>\n&#8220;(4) maintain an office for response and resolution that<br \/>\nshall establish mechanisms that allow for the reporting,<br \/>\ninvestigation, and resolution, pursuant to subsection (c), of<br \/>\nalleged sexual abuse in violation of the Center&#8217;s policies and<br \/>\nprocedures; and<br \/>\n&#8220;(5) ensure that the mechanisms under paragraph (4) provide<br \/>\nfair notice and an opportunity to be heard and protect the<br \/>\nprivacy and safety of complainants.<\/p>\n<p>&#8220;(b) &lt;&lt;NOTE: Applicability.&gt;&gt; Policies and Procedures.&#8211;The<br \/>\npolicies and procedures developed under subsection (a)(3) shall apply as<br \/>\nthough they were incorporated in and made a part of section 220524 of<br \/>\nthis title.<\/p>\n<p>&#8220;(c) Binding Arbitration.&#8211;<br \/>\n&#8220;(1) In general.&#8211;The Center may, in its discretion,<br \/>\nutilize a neutral arbitration body and develop policies and<br \/>\nprocedures to resolve allegations of sexual abuse within its<br \/>\njurisdiction to determine the opportunity of any amateur<br \/>\nathlete, coach, trainer, manager, administrator, or official,<br \/>\nwho is the subject of such an allegation, to participate in<br \/>\namateur athletic competition.<br \/>\n&#8220;(2) Preservation of rights.&#8211;Nothing in this section shall<br \/>\nbe construed as altering, superseding, or otherwise affecting<br \/>\nthe right of an individual within the Center&#8217;s jurisdiction to<br \/>\npursue civil remedies through the courts for personal injuries<br \/>\narising from abuse in violation of the Center&#8217;s policies and<br \/>\nprocedures, nor shall the Center condition the participation of<br \/>\nany such individual in a proceeding described in paragraph (1)<br \/>\nupon an agreement not to pursue such civil remedies.<\/p>\n<p>&#8220;(d) Limitation on Liability.&#8211;<br \/>\n&#8220;(1) In general.&#8211;Except as provided in paragraph (2), an<br \/>\napplicable entity shall not be liable for damages in any civil<br \/>\naction for defamation, libel, slander, or damage to reputation<br \/>\narising out of any action or communication, if the action arises<br \/>\nfrom the execution of the responsibilities or functions<br \/>\ndescribed in this section, section 220542, or section 220543.<br \/>\n&#8220;(2) Exception.&#8211;Paragraph (1) shall not apply in any<br \/>\naction in which an applicable entity acted with actual malice,<br \/>\nor provided information or took action not pursuant to this<br \/>\nsection, section 220542, or section 220543.<br \/>\n&#8220;(3) Definition of applicable entity.&#8211;In this subsection,<br \/>\nthe term `applicable entity&#8217; means&#8211;<br \/>\n&#8220;(A) the Center;<br \/>\n&#8220;(B) a national governing body;<br \/>\n&#8220;(C) a paralympic sports organization;<br \/>\n&#8220;(D) an amateur sports organization or other person<br \/>\nsanctioned by a national governing body under section<br \/>\n220525;<br \/>\n&#8220;(E) an amateur sports organization reporting under<br \/>\nsection 220530;<br \/>\n&#8220;(F) any officer, employee, agent, or member of an<br \/>\nentity described in subparagraph (A), (B), (C), (D), or<br \/>\n(E); and<\/p>\n<p>[[Page 132 STAT. 322]]<\/p>\n<p>&#8220;(G) any individual participating in a proceeding<br \/>\npursuant to this section.<br \/>\n&#8220;Sec. 220542. &lt;&lt;NOTE: 36 USC 220542.&gt;&gt; Additional duties.<\/p>\n<p>&#8220;(a) In General.&#8211;The Center shall&#8211;<br \/>\n&#8220;(1) develop training, oversight practices, policies, and<br \/>\nprocedures for implementation by a national governing body or<br \/>\nparalympic sports organization to prevent the abuse, including<br \/>\nemotional, physical, and sexual abuse, of any amateur athlete;<br \/>\nand<br \/>\n&#8220;(2) include in the policies and procedures developed under<br \/>\nsection 220541(a)(3)&#8211;<br \/>\n&#8220;(A) a requirement that all adult members of a<br \/>\nnational governing body, a paralympic sports<br \/>\norganization, or a facility under the jurisdiction of a<br \/>\nnational governing body or paralympic sports<br \/>\norganization, and all adults authorized by such members<br \/>\nto interact with an amateur athlete, report immediately<br \/>\nany allegation of child abuse of an amateur athlete who<br \/>\nis a minor to&#8211;<br \/>\n&#8220;(i) the Center, whenever such members or<br \/>\nadults learn of facts leading them to suspect<br \/>\nreasonably that an amateur athlete who is a minor<br \/>\nhas suffered an incident of child abuse; and<br \/>\n&#8220;(ii) law enforcement consistent with section<br \/>\n226 of the Victims of Child Abuse Act of 1990 (34<br \/>\nU.S.C. 20341);<br \/>\n&#8220;(B) a mechanism, approved by a trained expert on<br \/>\nchild abuse, that allows a complainant to report easily<br \/>\nan incident of child abuse to the Center, a national<br \/>\ngoverning body, law enforcement authorities, or other<br \/>\nappropriate authorities;<br \/>\n&#8220;(C) reasonable procedures to limit one-on-one<br \/>\ninteractions between an amateur athlete who is a minor<br \/>\nand an adult (who is not the minor&#8217;s legal guardian) at<br \/>\na facility under the jurisdiction of a national<br \/>\ngoverning body or paralympic sports organization without<br \/>\nbeing in an observable and interruptible distance from<br \/>\nanother adult, except under emergency circumstances;<br \/>\n&#8220;(D) procedures to prohibit retaliation, by any<br \/>\nnational governing body or paralympic sports<br \/>\norganization, against any individual who makes a report<br \/>\nunder subparagraph (A) or subparagraph (B);<br \/>\n&#8220;(E) oversight procedures, including regular and<br \/>\nrandom audits conducted by subject matter experts<br \/>\nunaffiliated with, and independent of, a national<br \/>\ngoverning body or a paralympic sports organization of<br \/>\neach national governing body and paralympic sports<br \/>\norganization to ensure that policies and procedures<br \/>\ndeveloped under that section are followed correctly and<br \/>\nthat consistent training is offered and given to all<br \/>\nadult members who are in regular contact with amateur<br \/>\nathletes who are minors, and subject to parental<br \/>\nconsent, to members who are minors, regarding prevention<br \/>\nof child abuse; and<br \/>\n&#8220;(F) a mechanism by which a national governing body<br \/>\nor paralympic sports organization can&#8211;<br \/>\n&#8220;(i) share confidentially a report of<br \/>\nsuspected child abuse of an amateur athlete who is<br \/>\na minor by a<\/p>\n<p>[[Page 132 STAT. 323]]<\/p>\n<p>member of a national governing body or paralympic<br \/>\nsports organization, or an adult authorized by a<br \/>\nnational governing body, paralympic sports<br \/>\norganization, or an amateur sports organization to<br \/>\ninteract with an amateur athlete who is a minor,<br \/>\nwith the Center, which in turn, may share with<br \/>\nrelevant national governing bodies, paralympic<br \/>\nsports organizations, and other entities; and<br \/>\n&#8220;(ii) withhold providing to an adult who is<br \/>\nthe subject of an allegation of child abuse<br \/>\nauthority to interact with an amateur athlete who<br \/>\nis a minor until the resolution of such<br \/>\nallegation.<\/p>\n<p>&#8220;(b) Rule of Construction.&#8211;Nothing in this section shall be<br \/>\nconstrued to limit the ability of a national governing body or<br \/>\nparalympic sports organization to impose an interim measure to prevent<br \/>\nan individual who is the subject of an allegation of sexual abuse from<br \/>\ninteracting with an amateur athlete prior to the Center exercising its<br \/>\njurisdiction over a matter.<br \/>\n&#8220;Sec. 220543. &lt;&lt;NOTE: 36 USC 220543.&gt;&gt; Records, audits, and<br \/>\nreports<\/p>\n<p>&#8220;(a) Records.&#8211;The Center shall keep correct and complete records<br \/>\nof account.<br \/>\n&#8220;(b) Report.&#8211;The Center shall submit an annual report to Congress,<br \/>\nincluding&#8211;<br \/>\n&#8220;(1) an audit conducted and submitted in accordance with<br \/>\nsection 10101; and<br \/>\n&#8220;(2) a description of the activities of the Center.&#8221;.<\/p>\n<p>(b) Conforming Amendment.&#8211;Section 220501(b) of title 36, United<br \/>\nStates Code, is amended&#8211;<br \/>\n(1) by redesignating paragraphs (4) through (8) as<br \/>\nparagraphs (6) through (10), respectively; and<br \/>\n(2) &lt;&lt;NOTE: Definitions.&gt;&gt; by inserting after paragraph<br \/>\n(3), the following:<br \/>\n&#8220;(4) `Center&#8217; means the United States Center for Safe Sport<br \/>\ndesignated under section 220541.<br \/>\n&#8220;(5) `child abuse&#8217; has the meaning given the term in<br \/>\nsection 212 of the Victims of Child Abuse Act of 1990 (34 U.S.C.<br \/>\n20302).&#8221;.<\/p>\n<p>(c) Technical Amendment.&#8211;The table of contents of chapter 2205 of<br \/>\ntitle 36, United States Code, &lt;&lt;NOTE: 36 USC 220501 prec.&gt;&gt; is amended<br \/>\nby adding at the end the following:<\/p>\n<p>&#8220;subchapter iii&#8211;united states center for safe sport<\/p>\n<p>&#8220;220541. Designation of United States Center for Safe Sport.<br \/>\n&#8220;220542. Additional duties.<br \/>\n&#8220;220543. Records, audits, and reports.&#8221;.<\/p>\n<p>SEC. 203. ADDITIONAL REQUIREMENTS FOR GRANTING SANCTIONS FOR<br \/>\nAMATEUR ATHLETIC COMPETITIONS.<\/p>\n<p>Section 220525(b)(4) is amended&#8211;<br \/>\n(1) in subparagraph (E), by striking &#8220;; and&#8221; and inserting<br \/>\na semicolon;<br \/>\n(2) in subparagraph (F), by striking the period at the end<br \/>\nand inserting &#8220;; and&#8221;; and<br \/>\n(3) by adding at the end the following:<br \/>\n&#8220;(G) the amateur sports organization or person<br \/>\nrequesting sanction from a national governing body will<br \/>\nimplement and abide by the policies and procedures to<br \/>\nprevent the abuse, including emotional, physical, and<br \/>\nchild<\/p>\n<p>[[Page 132 STAT. 324]]<\/p>\n<p>abuse, of amateur athletes participating in amateur<br \/>\nathletic activities applicable to such national<br \/>\ngoverning body.&#8221;.<br \/>\nSEC. 204. GENERAL REQUIREMENTS FOR YOUTH-SERVING AMATEUR SPORTS<br \/>\nORGANIZATIONS.<\/p>\n<p>(a) In General.&#8211;Subchapter II of chapter 2205 of title 36, United<br \/>\nStates Code, is amended by adding at the end the following:<br \/>\n&#8220;Sec. 220530. &lt;&lt;NOTE: 36 USC 220530.&gt;&gt; Other amateur sports<br \/>\norganizations<\/p>\n<p>&#8220;(a) In General.&#8211;An applicable amateur sports organization shall&#8211;<br \/>\n&#8220;(1) comply with the reporting requirements of section 226<br \/>\nof the Victims of Child Abuse Act of 1990 (34 U.S.C. 20341);<br \/>\n&#8220;(2) establish reasonable procedures to limit one-on-one<br \/>\ninteractions between an amateur athlete who is a minor and an<br \/>\nadult (who is not the minor&#8217;s legal guardian) at a facility<br \/>\nunder the jurisdiction of the applicable amateur sports<br \/>\norganization without being in an observable and interruptible<br \/>\ndistance from another adult, except under emergency<br \/>\ncircumstances;<br \/>\n&#8220;(3) offer and provide consistent training to all adult<br \/>\nmembers who are in regular contact with amateur athletes who are<br \/>\nminors, and subject to parental consent, to members who are<br \/>\nminors, regarding prevention and reporting of child abuse to<br \/>\nallow a complainant to report easily an incident of child abuse<br \/>\nto appropriate persons; and<br \/>\n&#8220;(4) prohibit retaliation, by the applicable amateur sports<br \/>\norganization, against any individual who makes a report under<br \/>\nparagraph (1).<\/p>\n<p>&#8220;(b) Definition of Applicable Amateur Sports Organization.&#8211;In this<br \/>\nsection, the term `applicable amateur sports organization&#8217; means an<br \/>\namateur sports organization&#8211;<br \/>\n&#8220;(1) that is not otherwise subject to the requirements<br \/>\nunder subchapter III;<br \/>\n&#8220;(2) that participates in an interstate or international<br \/>\namateur athletic competition; and<br \/>\n&#8220;(3) whose membership includes any adult who is in regular<br \/>\ncontact with an amateur athlete who is a minor.&#8221;.<\/p>\n<p>[[Page 132 STAT. 325]]<\/p>\n<p>(b) Technical Amendment.&#8211;The table of contents of chapter 2205 of<br \/>\ntitle 36, United States Code &lt;&lt;NOTE: 36 USC 220501 prec.&gt;&gt; , is amended<br \/>\nby inserting after the item relating to section 220529 the following:<\/p>\n<p>&#8220;220530.
