SHORT TITLE.<\/p>\n<p>This Act may be cited as the &#8220;Secret Service Recruitment and<br \/>\nRetention Act of 2018&#8221;.<br \/>\nSEC. 2. EXTENSION OF OVERTIME PAY EXCEPTION THROUGH 2018 FOR<br \/>\nPROTECTIVE SERVICES.<\/p>\n<p>(a) Amendments.&#8211;<br \/>\n(1) In general.&#8211;Section 2 of the Overtime Pay for<br \/>\nProtective Services Act of 2016 (5 U.S.C. 5547 note) is<br \/>\namended&#8211;<br \/>\n(A) in the section heading, by striking &#8220;in 2016&#8221;<br \/>\nand inserting &#8220;during 2016 through 2018&#8221;;<br \/>\n(B) in subsection (a), by striking &#8220;2016&#8221; and<br \/>\ninserting &#8220;2016, 2017, or 2018&#8221;; and<br \/>\n(C) in subsection (b), by striking paragraph (1) and<br \/>\ninserting the following:<br \/>\n&#8220;(1) In general.&#8211;Notwithstanding any other provision of<br \/>\nlaw, including section 5547(a) of title 5, United States Code,<br \/>\nand only to the extent that an appropriation is provided<br \/>\nspecifically in an appropriations Act for premium pay in excess<br \/>\nof the annual equivalent of the limitation on the rate of pay<br \/>\ncontained in section 5547(a), any covered employee may receive<br \/>\npremium pay during 2016, 2017, and 2018, to the extent provided<br \/>\nunder section 118 of the Treasury and General Government<br \/>\nAppropriations Act, 2001 (5 U.S.C. 5547 note).&#8221;.<br \/>\n(2) Clarifying provision.&#8211;Section 118 of the Treasury and<br \/>\nGeneral Government Appropriations Act, 2001 (5 U.S.C. 5547 note)<br \/>\nis amended, in the first sentence, by inserting &#8220;or 3056A&#8221;<br \/>\nafter &#8220;section 3056(a)&#8221;.<\/p>\n<p>(b) &lt;&lt;NOTE: 5 USC 5547 note.&gt;&gt; Effective Date.&#8211;The amendments made<br \/>\nby subsection (a) shall take effect as if enacted on December 31, 2016.<\/p>\n<p>(c) Report on Extensions.&#8211;Not later than January 30, 2018, and<br \/>\nJanuary 30, 2019, the Director of the Secret Service shall submit to the<br \/>\nCommittee on Homeland Security and the Committee on Oversight and<br \/>\nGovernment Reform of the House of Representatives and the Committee on<br \/>\nHomeland Security and Governmental Affairs of the Senate a report on the<br \/>\neffects of the amendment made by subsection (a)(2). The report shall<br \/>\ninclude, with respect to the previous calendar year&#8211;<\/p>\n<p>[[Page 132 STAT. 1247]]<\/p>\n<p>(1) the total number of United States Secret Service<br \/>\npersonnel receiving premium pay above the premium pay limitation<br \/>\nin subsection (a) of section 5547 of title 5, United States<br \/>\nCode;<br \/>\n(2) the total amount of premium pay for that calendar year<br \/>\npaid to United States Secret Service personnel above the premium<br \/>\npay limitation in such subsection;<br \/>\n(3) the mean and median amount of premium pay paid to United<br \/>\nStates Secret Service personnel above the premium pay limitation<br \/>\nin such subsection;<br \/>\n(4) the greatest amount paid to United States Secret Service<br \/>\npersonnel above the premium pay limitation in such subsection<br \/>\nand the number of employees who received that amount;<br \/>\n(5) notwithstanding the amendments made by subsection (a),<br \/>\nthe total number of United States Secret Service personnel who<br \/>\nwere not fully compensated for service because of the premium<br \/>\npay earnings limitation in section 118 of the Treasury and<br \/>\nGeneral Government Appropriations Act, 2001 (5 U.S.C. 5547<br \/>\nnote);<br \/>\n(6) the total amount of premium pay United States Secret<br \/>\nService personnel would have been paid but for the premium pay<br \/>\nearnings limitation in such section; and<br \/>\n(7) &lt;&lt;NOTE: Lists.&gt;&gt; a list of United States Secret Service<br \/>\npersonnel who, within the calendar year, received premium pay<br \/>\nabove the premium pay limitation in subsection (a) of section<br \/>\n5547 of title 5, United States Code, and separated from the<br \/>\nagency, including the type of separation in each case.<br \/>\nSEC. 3.
