Study on subnational compacts.<\/p>\n<p>TITLE I&#8211;ENHANCEMENT OF THE AFRICAN GROWTH AND OPPORTUNITY ACT<\/p>\n<p>SEC. 101. &lt;&lt;NOTE: 19 USC 3701 note.&gt;&gt; STATEMENT OF POLICY.<\/p>\n<p>It is the policy of the United States to support efforts to&#8211;<br \/>\n(1) improve the rule of law, promote free and fair<br \/>\nelections, strengthen and expand the private sector, and fight<br \/>\ncorruption in sub-Saharan Africa; and<br \/>\n(2) promote the role of women in social, political, and<br \/>\neconomic development in sub-Saharan Africa.<\/p>\n<p>[[Page 132 STAT. 1277]]<\/p>\n<p>SEC. 102. &lt;&lt;NOTE: 19 USC 3707 note.&gt;&gt; DEFINITIONS.<\/p>\n<p>In this title&#8211;<br \/>\n(1) Agoa website.&#8211;The term &#8220;AGOA Website&#8221; means the<br \/>\nwebsite established pursuant to section 103(a).<br \/>\n(2) Eligible sub-saharan african country.&#8211;The term<br \/>\n&#8220;eligible sub-Saharan African country&#8221; means a country that<br \/>\nthe President has determined meets the eligibility requirements<br \/>\nset forth in section 104 of the African Growth and Opportunity<br \/>\nAct (19 U.S.C. 3703).<br \/>\nSEC. 103. &lt;&lt;NOTE: President. 19 USC 3707.&gt;&gt; ACTIVITIES IN SUPPORT<br \/>\nOF TRANSPARENCY.<\/p>\n<p>(a) AGOA Website.&#8211;<br \/>\n(1) In general.&#8211;The President shall establish a publicly<br \/>\navailable website for the collection and dissemination of<br \/>\ninformation regarding the African Growth and Opportunity Act (19<br \/>\nU.S.C. 3701 et seq.).<br \/>\n(2) &lt;&lt;NOTE: Web posting.&gt;&gt; Contents.&#8211;The President shall<br \/>\npublish on the AGOA Website the information described in<br \/>\nparagraph (1), including&#8211;<br \/>\n(A) information and technical assistance provided at<br \/>\nUnited States Agency for International Development<br \/>\nregional trade hubs; and<br \/>\n(B) a link to the websites of United States<br \/>\nembassies located in eligible sub-Saharan African<br \/>\ncountries.<br \/>\n(3) Actions by united states embassies.&#8211;The Secretary of<br \/>\nState should direct United States embassies located in eligible<br \/>\nsub-Saharan African countries to&#8211;<br \/>\n(A) encourage individuals and businesses in such<br \/>\ncountries to use the benefits available under the<br \/>\nAfrican Growth and Opportunity Act; and<br \/>\n(B) include a link to the AGOA Website on the<br \/>\nwebsites of such diplomatic missions.<\/p>\n<p>(b) AGOA Forum.&#8211;After each meeting of the United States-Sub-Saharan<br \/>\nAfrica Trade and Economic Cooperation Forum, the President should<br \/>\npublish on the AGOA Website the following:<br \/>\n(1) The outcomes of the meeting of the Forum, including any<br \/>\ncommitments made by member countries and the private sector.<br \/>\n(2) An assessment of progress made with respect to any<br \/>\ncommitments made by member countries and the private sector from<br \/>\nthe previous meeting of the Forum.<\/p>\n<p>(c) Other Information.&#8211;The President should disseminate the<br \/>\ninformation required under this section in a digital format to the<br \/>\npublic and publish such information on the AGOA Website.<br \/>\nSEC. 104. ACTIVITIES IN SUPPORT OF TRADE CAPACITY BUILDING.<\/p>\n<p>The President should&#8211;<br \/>\n(1) develop and implement policies that&#8211;<br \/>\n(A) encourage and facilitate cross-boundary<br \/>\ncooperation among eligible sub-Saharan African countries<br \/>\nin order to facilitate trade; and<br \/>\n(B) encourage the provision of technical assistance<br \/>\nto eligible sub-Saharan African countries to establish<br \/>\nand sustain adequate trade capacity development;<br \/>\n(2) provide specific training for businesses in eligible<br \/>\nsub-Saharan African countries and government trade officials of<br \/>\nsuch countries on accessing the benefits under the African<\/p>\n<p>[[Page 132 STAT. 1278]]<\/p>\n<p>Growth and Opportunity Act and other trade preference programs;<br \/>\n(3) provide capacity building for African entrepreneurs and<br \/>\ntrade associations on production strategies, quality standards,<br \/>\nformation of cooperatives, market research, and market<br \/>\ndevelopment;<br \/>\n(4) provide capacity building training to promote<br \/>\ndiversification of African products and value-added processing;<br \/>\nand<br \/>\n(5) provide capacity building and technical assistance<br \/>\nfunding for African businesses and institutions to help such<br \/>\nbusinesses and institutions comply with United States<br \/>\ncounterterrorism initiatives and policies.<\/p>\n<p>TITLE II&#8211;MODERNIZATION OF THE MILLENNIUM CHALLENGE CORPORATION<\/p>\n<p>SEC. 201. CANDIDACY STATUS.<\/p>\n<p>(a) Low Income Countries.&#8211;Section 606(a) of the Millennium<br \/>\nChallenge Act of 2003 (22 U.S.C. 7705(a)) is amended&#8211;<br \/>\n(1) in paragraph (1)(B), by striking &#8220;(3)&#8221; and inserting<br \/>\n&#8220;(4)&#8221;;<br \/>\n(2) in paragraph (2)&#8211;<br \/>\n(A) by amending the paragraph heading to read as<br \/>\nfollows: &#8220;Fiscal years 2005 through 2012&#8221;; and<br \/>\n(B) by striking &#8220;fiscal year 2005 or a subsequent<br \/>\nfiscal year&#8221; and inserting &#8220;each of fiscal years 2005<br \/>\nthrough 2012&#8221;;<br \/>\n(3) by redesignating paragraph (3) as paragraph (4); and<br \/>\n(4) by inserting after paragraph (2) the following:<br \/>\n&#8220;(3) Fiscal year 2013 and subsequent fiscal years.&#8211;A<br \/>\ncountry shall be a candidate country for purposes of eligibility<br \/>\nfor assistance for fiscal year 2013 or a subsequent fiscal year<br \/>\nif the country&#8211;<br \/>\n&#8220;(A) has a per capita income not greater than the<br \/>\nlower middle income country threshold established by the<br \/>\nInternational Bank for Reconstruction and Development<br \/>\nfor such fiscal year;<br \/>\n&#8220;(B) is among the 75 countries identified by the<br \/>\nInternational Bank for Reconstruction and Development as<br \/>\nhaving the lowest per capita income; and<br \/>\n&#8220;(C) meets the requirements under paragraph<br \/>\n(1)(B).&#8221;.<\/p>\n<p>(b) Lower Middle Income Countries.&#8211;Section 606(b) of the Millennium<br \/>\nChallenge Act of 2003 (22 U.S.C. 7705(b)) is amended&#8211;<br \/>\n(1) in paragraph (1)&#8211;<br \/>\n(A) by amending the paragraph heading to read as<br \/>\nfollows: &#8220;Fiscal years 2006 through 2012&#8221;; and<br \/>\n(B) in the matter preceding subparagraph (A), by<br \/>\nstriking &#8220;fiscal year 2006 or a subsequent fiscal<br \/>\nyear&#8221; and inserting &#8220;fiscal years 2006 through 2012&#8221;;<br \/>\n(2) by redesignating paragraph (2) as paragraph (3); and<br \/>\n(3) by inserting after paragraph (1) the following:<br \/>\n&#8220;(2) Fiscal year 2013 and subsequent fiscal years.&#8211;In<br \/>\naddition to the countries described in subsection (a), a country<br \/>\nshall be a candidate country for purposes of eligibility<\/p>\n<p>[[Page 132 STAT. 1279]]<\/p>\n<p>for assistance for fiscal year 2013 or a subsequent fiscal year<br \/>\nif the country&#8211;<br \/>\n&#8220;(A) has a per capita income not greater than the<br \/>\nlower middle income country threshold established by the<br \/>\nInternational Bank for Reconstruction and Development<br \/>\nfor the fiscal year;<br \/>\n&#8220;(B) is not among the 75 countries identified by<br \/>\nthe International Bank for Reconstruction and<br \/>\nDevelopment as having the lowest per capita income; and<br \/>\n&#8220;(C) meets the requirements under subsection<br \/>\n(a)(1)(B).&#8221;.<\/p>\n<p>(c) Reclassification.&#8211;Section 606 of the Millennium Challenge Act<br \/>\nof 2003 (22 U.S.C. 7705) is amended&#8211;<br \/>\n(1) by redesignating subsection (c) as subsection (d); and<br \/>\n(2) by inserting after subsection (b) the following:<\/p>\n<p>&#8220;(c) Treatment of Countries With Per Capita Income Changes.&#8211;A<br \/>\ncountry qualifying for candidate status under this section with a per<br \/>\ncapita income that changes during the fiscal year such that the country<br \/>\nwould be reclassified from a low income country to a lower middle income<br \/>\ncountry or from a lower middle income country to a low income country<br \/>\nshall retain its candidacy status in its former income classification<br \/>\nfor such fiscal year and the 2 subsequent fiscal years.&#8221;.<br \/>\nSEC. 202. CARRYOVER AUTHORITY FOR PRIVATE-SECTOR MEMBERS OF BOARD<br \/>\nOF DIRECTORS.<\/p>\n<p>Section 604(c)(4)(B) of the Millennium Challenge Act of 2003 (22<br \/>\nU.S.C. 7703(c)(4)(B)) is amended to read as follows:<br \/>\n&#8220;(B) Other members.&#8211;Each member of the Board<br \/>\ndescribed in paragraph (3)(B)&#8211;<br \/>\n&#8220;(i) shall be appointed for a term of 3<br \/>\nyears;<br \/>\n&#8220;(ii) may be reappointed for a term of an<br \/>\nadditional 2 years; and<br \/>\n&#8220;(iii) may continue to serve in each such<br \/>\nappointment until the earlier of&#8211;<br \/>\n&#8220;(I) the date on which his or her<br \/>\nsuccessor is appointed; or<br \/>\n&#8220;(II) the date that is 1 year after<br \/>\nthe expiration of his or her appointment<br \/>\nor reappointment, as the case may be.&#8221;.<br \/>\nSEC. 203. ADDITIONAL REPORTING TO THE BOARD ON THE TREATMENT OF<br \/>\nCIVIL SOCIETY IN AN ELIGIBLE COUNTRY.<\/p>\n<p>Section 607 of the Millennium Challenge Act of 2003 (22 U.S.C. 7706)<br \/>\nis amended&#8211;<br \/>\n(1) in subsection (a), by adding at the end the following:<br \/>\n&#8220;A determination whether a country is eligible for a<br \/>\nsubsequent, non-concurrent Millennium Challenge Compact shall<br \/>\nalso be based, to the extent practicable, on significantly<br \/>\nimproved performance across the criteria in subsection (b) that,<br \/>\nat a minimum, are relevant to the preceding Compact, compared to<br \/>\nthe country&#8217;s performance with respect to such criteria when<br \/>\nselected for such preceding Compact.&#8221;<br \/>\n(2) in subsection (b)(1)&#8211;<br \/>\n(A) in subparagraph (D), by striking &#8220;and&#8221; at the<br \/>\nend;<br \/>\n(B) in subparagraph (E), by adding &#8220;and&#8221; at the<br \/>\nend; and<br \/>\n(C) by adding at the end the following:<\/p>\n<p>[[Page 132 STAT. 1280]]<\/p>\n<p>&#8220;(F) the quality of the civil society enabling<br \/>\nenvironment;&#8221;;<br \/>\n(3) by redesignating subsections (d) and (e) as subsections<br \/>\n(e) and (f), respectively; and<br \/>\n(4) by inserting after subsection (c) the following:<\/p>\n<p>&#8220;(d) Reporting on Treatment of Civil Society. &lt;&lt;NOTE: Time<br \/>\nperiod. Classified information.&gt;&gt; &#8211;For the 7-year period beginning on<br \/>\nthe date of the enactment of this subsection, before the Board selects<br \/>\nan eligible country for a Compact under subsection (c), the Corporation<br \/>\nshall provide information to the Board regarding the country&#8217;s treatment<br \/>\nof civil society, including classified information, as<br \/>\nappropriate. &lt;&lt;NOTE: Assessment. Analysis.&gt;&gt; The information shall<br \/>\ninclude an assessment and analysis of factors including&#8211;<br \/>\n&#8220;(1) any relevant laws governing the formation or<br \/>\nestablishment of a civil society organization, particularly laws<br \/>\nintended to curb the activities of foreign civil society<br \/>\norganizations;<br \/>\n&#8220;(2) any relevant laws governing the operations of a civil<br \/>\nsociety organization, particularly those laws seeking to define<br \/>\nor otherwise regulate the actions of foreign civil society<br \/>\norganizations;<br \/>\n&#8220;(3) laws relating to the legal status of civil society<br \/>\norganizations, including laws which effectively discriminate<br \/>\nagainst foreign civil society organizations as compared to<br \/>\nsimilarly situated domestic organizations;<br \/>\n&#8220;(4) laws regulating the freedom of expression and peaceful<br \/>\nassembly; and<br \/>\n&#8220;(5) laws regulating the usage of the Internet,<br \/>\nparticularly by foreign civil society organizations.&#8221;.<br \/>\nSEC. 204. CONCURRENT COMPACTS UNDER THE MILLENNIUM CHALLENGE ACT<br \/>\nOF 2003.<\/p>\n<p>(a) In General.&#8211;Section 609 of the Millennium Challenge Act of 2003<br \/>\n(22 U.S.C. 7708) is amended&#8211;<br \/>\n(1) by striking the first sentence of subsection (k);<br \/>\n(2) by redesignating subsection (k) (as so amended) as<br \/>\nsubsection (l); and<br \/>\n(3) by inserting after subsection (j) the following:<\/p>\n<p>&#8220;(k) Concurrent Compacts.&#8211;An eligible country that has entered<br \/>\ninto and has in effect a Compact under this section may enter into and<br \/>\nhave in effect at the same time not more than one additional Compact in<br \/>\naccordance with the requirements of this title if&#8211;<br \/>\n&#8220;(1) one or both of the Compacts are or will be for<br \/>\npurposes of regional economic integration, increased regional<br \/>\ntrade, or cross-border collaborations; and<br \/>\n&#8220;(2) &lt;&lt;NOTE: Determination.&gt;&gt; the Board determines that<br \/>\nthe country is making considerable and demonstrable progress in<br \/>\nimplementing the terms of the existing Compact and supplementary<br \/>\nagreements thereto.&#8221;.<\/p>\n<p>(b) Conforming Amendment.&#8211;Section 613(b)(2)(A) of such Act (22<br \/>\nU.S.C. 7712(b)(2)(A)) is amended by striking &#8220;the&#8221; before &#8220;Compact&#8221;<br \/>\nand inserting &#8220;any&#8221;.<br \/>\n(c) &lt;&lt;NOTE: 22 USC 7708 note.&gt;&gt; Applicability.&#8211;The amendments made<br \/>\nby this section apply with respect to Compacts entered into between the<br \/>\nUnited States and an eligible country under the Millennium Challenge Act<br \/>\nof 2003 before, on, or after the date of the enactment of this Act.<\/p>\n<p>[[Page 132 STAT. 1281]]<\/p>\n<p>SEC. 205. PUBLIC NOTIFICATION OF ENTERING INTO A COMPACT.<\/p>\n<p>Section 610 of the Millennium Challenge Act of 2003 (22 U.S.C. 7709)<br \/>\nis amended to read as follows:<br \/>\n&#8220;SEC. 610. &lt;&lt;NOTE: Deadlines.&gt;&gt; CONGRESSIONAL AND PUBLIC<br \/>\nNOTIFICATION.<\/p>\n<p>&#8220;(a) Congressional Consultations and Notifications.&#8211;<br \/>\n&#8220;(1) In general.&#8211;The Board, acting through the Chief<br \/>\nExecutive Officer, shall consult with and notify the appropriate<br \/>\ncongressional committees not later than 15 days before taking<br \/>\nany of the actions described in paragraph (2).<br \/>\n&#8220;(2) Actions described.&#8211;The actions described in this<br \/>\nparagraph are&#8211;<br \/>\n&#8220;(A) providing assistance for an eligible country<br \/>\nunder section 609(g);<br \/>\n&#8220;(B) commencing negotiations with an eligible<br \/>\ncountry to provide assistance for&#8211;<br \/>\n&#8220;(i) a Compact under section 605; or<br \/>\n&#8220;(ii) an agreement under section 616;<br \/>\n&#8220;(C) signing such a Compact or agreement; and<br \/>\n&#8220;(D) terminating assistance under such a Compact or<br \/>\nagreement.<br \/>\n&#8220;(3) &lt;&lt;NOTE: Reports.&gt;&gt; Economic justification.&#8211;Any<br \/>\nnotification relating to the intent to negotiate or sign a<br \/>\nCompact shall include a report describing the projected economic<br \/>\njustification for the Compact, including, as applicable&#8211;<br \/>\n&#8220;(A) the expected economic rate of return of the<br \/>\nCompact;<br \/>\n&#8220;(B) a cost-benefit analysis of the Compact;<br \/>\n&#8220;(C) a description of the impact on beneficiary<br \/>\npopulations;<br \/>\n&#8220;(D) the likelihood that the investment will<br \/>\ncatalyze private sector investments; and<br \/>\n&#8220;(E) any other applicable economic factors that<br \/>\njustify each project to be funded under such a Compact<br \/>\nto the extent practicable and appropriate.<br \/>\n&#8220;(4) &lt;&lt;NOTE: Assessments.&gt;&gt; Risk management plan.&#8211;Not<br \/>\nlater than 60 days before signing each concurrent Compact, as<br \/>\nauthorized under section 609, the Board, acting through the<br \/>\nChief Executive Officer, shall consult with and provide to the<br \/>\nappropriate congressional committees&#8211;<br \/>\n&#8220;(A) an assessment and, as appropriate, the<br \/>\nidentification of potential measures to mitigate risks,<br \/>\nof&#8211;<br \/>\n&#8220;(i) the countries&#8217; commitment to regional<br \/>\nintegration and cross-border cooperation and<br \/>\ncapacity to carry out commitments;<br \/>\n&#8220;(ii) political and policy risks, including<br \/>\nrisks that could affect country eligibility;<br \/>\n&#8220;(iii) risks associated with realizing<br \/>\neconomic returns;<br \/>\n&#8220;(iv) time and completion risks; and<br \/>\n&#8220;(v) cost and financial risks; and<br \/>\n&#8220;(B) an assessment of measures to be taken to<br \/>\nmitigate any identified risks, including&#8211;<br \/>\n&#8220;(i) securing other potential donors to<br \/>\nfinance projects or parts of projects as needed;<br \/>\nand<br \/>\n&#8220;(ii) partnering with regional organizations<br \/>\nto support and oversee effective cross-border<br \/>\ncooperation.<\/p>\n<p>[[Page 132 STAT. 1282]]<\/p>\n<p>&#8220;(b) &lt;&lt;NOTE: Web posting.&gt;&gt; Congressional and Public Notification<br \/>\nAfter Entering Into a Compact.&#8211;Not later than 10 days after entering<br \/>\ninto a Compact with an eligible country, the Board, acting through the<br \/>\nChief Executive Officer, shall&#8211;<br \/>\n&#8220;(1) publish the text of the Compact on the website of the<br \/>\nCorporation;<br \/>\n&#8220;(2) &lt;&lt;NOTE: Summary.&gt;&gt; provide the appropriate<br \/>\ncongressional committees with a detailed summary of the Compact<br \/>\nand, upon request, the text of the Compact; and<br \/>\n&#8220;(3) &lt;&lt;NOTE: Federal Register, publication.&gt;&gt; publish in<br \/>\nthe Federal Register a detailed summary of the Compact and a<br \/>\nnotice of availability of the text of the Compact on the website<br \/>\nof the Corporation.&#8221;.<br \/>\nSEC. 206. DISCLOSURE.<\/p>\n<p>(a) Requirement for Timely Disclosure.&#8211;Section 612(a) of the<br \/>\nMillennium Challenge Act of 2003 (22 U.S.C. 7711(a)) is amended&#8211;<br \/>\n(1) in the subsection heading, by inserting &#8220;Timely&#8221;<br \/>\nbefore &#8220;Disclosure&#8221;; and<br \/>\n(2) in the matter preceding paragraph (1)&#8211;<br \/>\n(A) &lt;&lt;NOTE: Deadline.&gt;&gt; by striking &#8220;The<br \/>\nCorporation&#8221; and inserting &#8220;Not later than 90 days<br \/>\nafter the last day of each fiscal quarter, the<br \/>\nCorporation&#8221;; and<br \/>\n(B) by striking &#8220;on at least a quarterly basis,&#8221;.<\/p>\n<p>(b) Dissemination.&#8211;Section 612(b) of the Millennium Challenge Act<br \/>\nof 2003 (22 U.S.C. 7711(b)) is amended to read as follows:<br \/>\n&#8220;(b) Dissemination.&#8211; &lt;&lt;NOTE: Public information.&gt;&gt; The Board,<br \/>\nacting through the Chief Executive Officer, shall make the information<br \/>\nrequired to be disclosed under subsection (a) available to the public&#8211;<br \/>\n&#8220;(1) &lt;&lt;NOTE: Web posting.&gt;&gt; by publishing it on the<br \/>\nwebsite of the Corporation;<br \/>\n&#8220;(2) &lt;&lt;NOTE: Notification. Federal Register,<br \/>\npublication.&gt;&gt; by providing notice of the availability of such<br \/>\ninformation in the Federal Register; and<br \/>\n&#8220;(3) by any other methods that the Board determines to be<br \/>\nappropriate.&#8221;.<br \/>\nSEC. 207. RESTRICTION ON THE USE OF ASSISTANCE UNDER SECTION 616.<\/p>\n<p>Section 616(d) of the Millennium Challenge Act of 2003 (22 U.S.C.<br \/>\n7715(d)) is amended to read as follows:<br \/>\n&#8220;(d) Funding.&#8211;<br \/>\n&#8220;(1) Limitation.&#8211;Not more than 10 percent of the amounts<br \/>\nmade available to carry out this Act for a fiscal year may be<br \/>\nmade available to carry out this section.<br \/>\n&#8220;(2) Restriction relating to assistance.&#8211;None of the funds<br \/>\nauthorized to carry out the purposes of this Act shall be<br \/>\navailable for assistance under this section to a country that<br \/>\ndoes not qualify as a candidate country under section 606 for<br \/>\nthe fiscal year during which such assistance is provided.&#8221;.<br \/>\nSEC. 208. STUDY ON SUBNATIONAL COMPACTS.<\/p>\n<p>(a) &lt;&lt;NOTE: Deadline. Assessments.&gt;&gt; In General.&#8211;Not later than<br \/>\n180 days after the date of the enactment of this Act, the Board of the<br \/>\nMillennium Challenge Corporation, acting through the Chief Executive<br \/>\nOfficer, shall submit a study to the appropriate congressional<br \/>\ncommittees that assesses the feasibility and desirability of developing<br \/>\npartnerships at the subnational level within candidate countries that<br \/>\nwould be complementary to, and, as applicable, concurrent with, any<\/p>\n<p>[[Page 132 STAT. 1283]]<\/p>\n<p>Millennium Challenge Corporation national-level or regional investments.<\/p>\n<p>(b) Content.&#8211;The study required under subsection (a) shall<br \/>\nexamine&#8211;<br \/>\n(1) the extent to which targeting investments at the<br \/>\nsubnational level might provide new opportunities for reducing<br \/>\npoverty through economic growth;<br \/>\n(2) the extent to which traditional approaches to defining<br \/>\npoverty may not adequately capture the nature of poverty within<br \/>\na country;<br \/>\n(3) the types of subnational entities that might be<br \/>\nappropriate partners for subnational Millennium Challenge<br \/>\nCorporation compacts;<br \/>\n(4) how candidates for subnational partners might best be<br \/>\nidentified; and<br \/>\n(5) what role each national government should play in<br \/>\ncreating or implementing a subnational partnership.<\/p>\n<p>(c) &lt;&lt;NOTE: Definition.&gt;&gt; Appropriate Congressional Committees.&#8211;In<br \/>\nthis subsection, the term &#8220;appropriate congressional committees&#8221;<br \/>\nmeans&#8211;<br \/>\n(1) the Committee on Foreign Relations of the Senate;<br \/>\n(2) the Committee on Appropriations of the Senate;<br \/>\n(3) the Committee on Foreign Affairs of the House of<br \/>\nRepresentatives;
