An Act<\/p>\n
To amend title 38, United States Code, to provide for requirements
\nrelating to the reassignment of Department of Veterans Affairs senior
\nexecutive employees. <<NOTE: June 21, 2018 – [H.R. 2772]>><\/p>\n
Be it enacted by the Senate and House of Representatives of the
\nUnited States of America in Congress assembled, <<NOTE: Department of
\nVeterans Affairs Senior Executive Accountability Act of 2018. 38 USC 101
\nnote.>>
\nSECTION 1. SHORT TITLE.<\/p>\n
This Act may be cited as the “Department of Veterans Affairs Senior
\nExecutive Accountability Act of 2018” or the “SEA Act of 2018”.
\nSEC. 2. SEMIANNUAL REPORTS ON REASSIGNMENT OF DEPARTMENT OF
\nVETERANS AFFAIRS SENIOR EXECUTIVE EMPLOYEES.<\/p>\n
(a) In General.–Subchapter I of chapter 7 of title 38, United
\nStates Code, is amended by adding at the end the following new section:
\n“Sec. <<NOTE: 38 USC 727.>> 727. Reassignment of senior
\nexecutives<\/p>\n
“(a) Approval of Reassignments.–No individual employed in a senior
\nexecutive position at the Department may be reassigned to another such
\nposition at the Department unless such reassignment is approved in
\nwriting and signed by the Secretary.
\n“(b) Semiannual Reports Required.–(1) Not later than June 30 and
\nDecember 31 of each year, the Secretary shall submit to Congress a
\nreport on the reassignment of individuals employed in senior executive
\npositions at the Department to other such positions at the Department
\nduring the period covered by the report.
\n“(2) Each report submitted under paragraph (1) shall describe the
\npurpose of each reassignment and the costs associated with such
\nreassignment.
\n“(3) For purposes of paragraph (2), costs associated with a
\nreassignment may only include the following:
\n“(A) A salary increase.
\n“(B) Temporary travel expenses for the individual or the
\nfamily of the individual.
\n“(C) Moving expenses.
\n“(D) A paid incentive.<\/p>\n
“(c) Senior Executive Position Defined.–In this section, the term
\n`senior executive position’ has the meaning given such term in section
\n713(d) of this title.”.<\/p>\n

(b) Clerical Amendment.–The table of sections at the beginning of
\nsuch chapter is <<NOTE: 38 USC 701 prec.>> amended by inserting after
\nthe item relating to section 725 the following new item:<\/p>\n
“727. Reassignment of senior executives.”.<\/p>\n
