A reduction of the rolling resistance of tyres may therefore contribute significantly to the energy efficiency of road transport and thus to the reduction of emissions.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(5)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Tyres are characterised by a number of parameters which are interrelated. Improving one parameter such as rolling resistance may have an adverse impact on other parameters such as wet grip, while improving wet grip may have an adverse impact on external rolling noise. Tyre manufacturers should be encouraged to optimise all parameters beyond the standards already achieved.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(6)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Fuel-efficient tyres are cost-effective since fuel savings more than compensate for the increased purchase price of tyres stemming from higher production costs.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(7)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Regulation (EC) No\u00a0661\/2009 of the European Parliament and of the Council of 13\u00a0July 2009 concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units intended therefor\u00a0(<span class=\"super\">3<\/span>) sets out minimum requirements for the rolling resistance of tyres. Technological developments make it possible to significantly decrease energy losses due to tyre rolling resistance beyond those minimum requirements. To reduce the environmental impact of road transport, it is therefore appropriate to lay down provisions to encourage end-users to purchase more fuel-efficient tyres by providing harmonised information on that parameter.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(8)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Traffic noise is a significant nuisance and has a harmful effect on health. Regulation (EC) No\u00a0661\/2009 sets out minimum requirements for the external rolling noise of tyres. Technological developments make it possible to significantly reduce external rolling noise beyond those minimum requirements. To reduce traffic noise, it is therefore appropriate to lay down provisions to encourage end-users to purchase tyres with low external rolling noise by providing harmonised information on that parameter.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(9)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">The provision of harmonised information on external rolling noise would also facilitate the implementation of measures against traffic noise and contribute to increased awareness of the effect of tyres on traffic noise within the framework of Directive 2002\/49\/EC of the European Parliament and of the Council of 25\u00a0June 2002 relating to the assessment and management of environmental noise\u00a0(<span class=\"super\">4<\/span>).<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(10)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Regulation (EC) No\u00a0661\/2009 sets out minimum requirements for the wet grip performance of tyres. Technological developments make it possible to significantly improve wet grip beyond those minimum requirements, and thus to reduce wet braking distances. To improve road safety, it is therefore appropriate to lay down provisions to encourage end-users to purchase tyres with high wet grip performance by providing harmonised information about that parameter.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(11)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">The provision of information on wet grip may not reflect the primary performance of tyres specifically designed for snow and ice conditions. Taking into account the fact that harmonised testing methods are not yet available in respect of such tyres, it is appropriate to provide for the possibility of adapting their grip grading at a later stage.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(12)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">The provision of information on tyre parameters in the form of a standard label is likely to influence purchasing decisions by end-users in favour of safer, quieter and more fuel-efficient tyres. This, in turn, is likely to encourage tyre manufacturers to optimise those tyre parameters, which would pave the way for more sustainable consumption and production.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(13)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">A multiplicity of rules concerning the labelling of tyres across Member States would create barriers to intra-Community trade and increase the administrative burden and testing costs for tyre manufacturers.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(14)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Replacement tyres account for 78\u00a0% of the tyre market. It is therefore appropriate to inform the end-user about the parameters of replacement tyres as well as tyres fitted on new vehicles.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(15)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">The need for greater information on tyre fuel efficiency and other parameters is relevant for consumers, as well as fleet managers and transport undertakings, which cannot easily compare the parameters of different tyre brands in the absence of a labelling and harmonised testing regime. It is therefore appropriate to include C1, C2 and\u00a0C3 tyres within the scope of this Regulation.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(16)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">The energy label which ranks products on a scale from \u2018A\u2019 to \u2018G\u2019, as applied to household appliances pursuant to Council Directive 92\/75\/EEC of 22\u00a0September 1992 on the indication by labelling and standard product information of the consumption of energy and other resources by household appliances\u00a0(<span class=\"super\">5<\/span>), is well known by consumers and has proven to be successful in promoting more efficient appliances. The same design should be used for the labelling of tyre fuel efficiency.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(17)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">The display of a label on tyres at the point of sale, as well as in technical promotional material, should ensure that distributors as well as potential end-users receive harmonised information on tyre fuel efficiency, wet grip performance and external rolling noise at the time and place of the purchasing decision.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(18)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Some end-users choose tyres before arriving at the point of sale, or purchase tyres by mail order. To ensure that those end-users can also make an informed choice on the basis of harmonised information on tyre fuel efficiency, wet grip performance and external rolling noise, labels should be displayed in all technical promotional material, including where such material is made available on the Internet. Technical promotional material does not include advertisements in billboards, newspapers, magazines, radio broadcasting, television and similar online formats.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(19)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Potential end-users should be provided with information explaining each component of the label and its relevance. It is appropriate that minimum fuel efficiency and wet grip classes be determined below which such incentives may not be granted in order to avoid fragmentation of the internal market. Such incentives may constitute State aid. This Regulation should be without prejudice to the outcome of any future State aid procedure which may be undertaken in accordance with Articles\u00a087 and\u00a088 of the Treaty with respect to such incentives and should not cover taxation and fiscal matters.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(22)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">Compliance with the provisions on labelling by suppliers and distributors is essential in order to achieve the aims of those provisions and to ensure a level playing field within the Community. Since those measures are of general scope and are designed to amend non-essential elements of this Regulation, inter alia, by supplementing it with new non-essential elements, they must be adopted in safety, and the economic and environmental efficiency of road transport by promoting fuel-efficient and safe tyres with low noise levels.<\/p>\n<p class=\"normal\">2.\u00a0\u00a0\u00a0This Regulation establishes a framework for the provision of harmonised information on tyre parameters through labelling, allowing end-users to make an informed choice when purchasing tyres.<\/p>\n<p id=\"d1e355-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a02<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Scope<\/p>\n<p class=\"normal\">1.\u00a0\u00a0\u00a0This \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">5.<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">\u2018technical documentation\u2019 means information relating to tyres, including the manufacturer and brand of the tyre; description of the tyre type or the grouping of tyres determined for the declaration of the fuel efficiency class, wet width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">11.<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">\u2018making available on the market\u2019 means any supply of a product for distribution or use on the Community market in the course of a commercial activity, whether in return for payment or free of charge;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">12.<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">\u2018end-user\u2019 means a consumer, as well as a fleet manager or road transport undertaking, that buys or is expected to buy a tyre;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">13.<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">\u2018essential parameter\u2019 means a tyre parameter such as rolling resistance, wet grip or external rolling noise that has a notable impact on the environment, road safety or health during use.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p id=\"d1e550-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a04<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Responsibilities of tyre suppliers<\/p>\n<p class=\"normal\">1.\u00a0\u00a0\u00a0Suppliers shall ensure that C1 and\u00a0C2 tyres, which are delivered to distributors or end-users, are:<\/p>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(a)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">equipped with a sticker on the tyre tread displaying a label indicating the fuel efficiency class as set out in Annex\u00a0I, Part A, the external rolling noise class and measured value as set out in Annex\u00a0I, Part C and, where applicable, the wet grip class as set out in Annex\u00a0I, Part B,<\/p>\n<p class=\"normal\">or<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(b)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">for each batch of one or more identical tyres delivered, accompanied by a label in printed format indicating the fuel efficiency class as set out in Annex\u00a0I, Part A, the external rolling noise class and measured value as set out in Annex\u00a0I, Part C and, where applicable, the wet grip class as set out in Annex\u00a0I, Part B.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p class=\"normal\">2.\u00a0\u00a0\u00a0The format of the sticker and the label referred to in paragraph\u00a01 shall be as prescribed in Annex\u00a0II.<\/p>\n<p class=\"normal\">3.\u00a0\u00a0\u00a0Suppliers shall state the fuel efficiency class, the external rolling noise class and measured value and, where applicable, the wet grip class, of C1, C2 and\u00a0C3 tyres in technical promotional material, including on their websites, as set out in Annex\u00a0I, in the order specified in Annex\u00a0III.<\/p>\n<p class=\"normal\">4.\u00a0\u00a0\u00a0Suppliers shall make technical documentation available to the authorities of Member States on request, for a period ending five years after the last tyre of a given tyre type has been made available on the market. The technical documentation shall be sufficiently detailed as to allow the authorities to verify the accuracy of information provided on the label with regard to fuel efficiency, wet grip and external rolling noise.<\/p>\n<p id=\"d1e591-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a05<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Responsibilities of tyre distributors<\/p>\n<p class=\"normal\">1.\u00a0\u00a0\u00a0Distributors shall ensure that:<\/p>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(a)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">tyres, at the point of sale, bear the sticker provided by suppliers in accordance with Article\u00a04(1)(a) in a clearly visible position,<\/p>\n<p class=\"normal\">or<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(b)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">before the sale of the tyre, the label referred to in Article\u00a04(1)(b) is shown to the end-user and is clearly displayed in the immediate proximity of the tyre at the point of sale.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p class=\"normal\">2.\u00a0\u00a0\u00a0Where tyres offered for sale are not visible to the end-user, distributors shall provide end-users with information on the fuel efficiency class, wet grip class and external rolling noise class and measured value of those tyres.<\/p>\n<p class=\"normal\">3.\u00a0\u00a0\u00a0For C1, C2 and\u00a0C3 tyres, distributors shall state the fuel efficiency class, the external rolling noise measured value and, where applicable, the wet grip class, as set out in Annex\u00a0I, on or with the bills delivered to end-users when they purchase tyres.<\/p>\n<p id=\"d1e627-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a06<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Responsibilities of vehicle suppliers and vehicle distributors<\/p>\n<p class=\"normal\">Where end users are offered a choice at the point of sale between different tyres to be fitted on a new vehicle which they are intending to acquire, vehicle suppliers and distributors shall, before the sale, provide them with information, for each of the tyres offered, on the fuel efficiency class, the external rolling noise class and measured value, and, where applicable, the wet grip class of C1, C2 and\u00a0C3 tyres, as set out in Annex\u00a0I and in the order specified in Annex\u00a0III. That information shall be included at least in the technical promotional material.<\/p>\n<p id=\"d1e634-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a07<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Harmonised testing methods<\/p>\n<p class=\"normal\">The information to be provided under Articles\u00a04, 5 and\u00a06 on the fuel efficiency class, the external rolling noise class and measured value, and the wet grip class of tyres shall be obtained by applying the harmonised testing methods referred to in Annex\u00a0I.<\/p>\n<p id=\"d1e641-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a08<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Verification procedure<\/p>\n<p class=\"normal\">Member States shall assess the conformity of the declared fuel efficiency and wet grip classes, within the meaning of Annex\u00a0I, Parts A and B, and the declared external rolling noise class and measured value within the meaning of Annex\u00a0I, Part C, in accordance with the procedure set out in Annex\u00a0IV.<\/p>\n<p id=\"d1e648-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a09<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Internal market<\/p>\n<p class=\"normal\">1.\u00a0\u00a0\u00a0Where the requirements of this Regulation are complied with, Member States shall neither prohibit nor restrict the making available on the market of the tyres referred to in Article\u00a02 on grounds of product information.<\/p>\n<p class=\"normal\">2.\u00a0\u00a0\u00a0Unless they have evidence to the contrary, Member States shall consider that labels and product information comply with this Regulation. They may require suppliers to provide technical documentation, in accordance with Article\u00a04(4), in order to assess the accuracy of the declared values and classes.<\/p>\n<p id=\"d1e663-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a010<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Incentives<\/p>\n<p class=\"normal\">Member States shall not provide incentives with regard to tyres below class C with respect to either fuel efficiency or wet grip within the meaning of Annex\u00a0I, Parts A and B respectively. Taxation and fiscal measures do not constitute incentives for the purpose of this Regulation.<\/p>\n<p id=\"d1e670-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a011<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Amendments and adaptations to technical progress<\/p>\n<p class=\"normal\">The following measures, designed to amend non-essential elements of this Regulation, inter alia, by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article\u00a013(2):<\/p>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(a)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">introduction of information requirements with respect to wet grip grading of C2 and\u00a0C3 tyres, provided that suitable harmonised testing methods are available;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(b)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">adaptation, where relevant, of grip grading to the technical specificities of tyres primarily designed to perform better in ice and\/or snow conditions than a normal tyre with regard to their ability to initiate, maintain, or stop vehicle motion;<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(c)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">adaptation of Annexes\u00a0I to\u00a0IV to technical center;\">Enforcement<\/p>\n<p class=\"normal\">In accordance with Regulation (EC) No\u00a0765\/2008 Member States shall ensure that the authorities responsible for market surveillance verify compliance with Articles\u00a04, 5 and\u00a06 of this Regulation.<\/p>\n<p id=\"d1e705-46-1\" class=\"ti-art\" style=\"text-align: center;\">Article\u00a013<\/p>\n<p class=\"sti-art\" style=\"text-align: center;\">Committee procedure<\/p>\n<p class=\"normal\">1.\u00a0\u00a0\u00a0The Commission shall be assisted by a committee.<\/p>\n<p class=\"normal\">2.\u00a0\u00a0\u00a0Where fuel efficiency and wet grip classes as well as the declared external rolling noise class and measured value must be assessed for each tyre type or each grouping of tyres as determined by the <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(a)<\/p>\n<\/td>\n<td valign=\"top\">\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(i)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">a single tyre is tested first. If the measured value meets the declared class or external rolling noise measured value, the test is passed;<\/p>\n<p class=\"normal\">and<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\">\n<colgroup>\n<col width=\"4%\" \/>\n<col width=\"96%\" \/> <\/colgroup>\n<tbody>\n<tr>\n<td valign=\"top\">\n<p class=\"normal\">(ii)<\/p>\n<\/td>\n<td valign=\"top\">\n<p class=\"normal\">if the measured value does not meet the declared class or external rolling noise measured value, three more tyres are tested.
