Having regard to the above applications lodged on 3 November 2017 and 6 November 2017 respectively,<\/p>\n
Having regard to the formal declarations accepting a friendly settlement of the cases,<\/p>\n
Having deliberated, decides as follows:<\/p>\n
FACTS AND PROCEDURE<\/strong><\/p>\n 1.\u00a0\u00a0The applicant in the first case, (application no. 78628\/17) Ms.\u00a0\u0160aha\u00a0Im\u0161irovi\u0107, is a national of Bosnia and Herzegovina, who was born in 1953 and lives in Banovi\u0107i.<\/p>\n 2.\u00a0\u00a0The applicants in the second case, (application no. 79133\/17) Ms.\u00a0Sabira\u00a0Emki\u0107 and Ms. Fata Emki\u0107, are both nationals of Bosnia and Herzegovina, who were born in 1957 and 1947, respectively, and live in GornjiPasci.<\/p>\n 3.\u00a0\u00a0All applicants were represented before the Court by Mr\u00a0H.\u00a0Salkanovi\u0107, a lawyer practising in \u017divinice<\/p>\n 4.\u00a0\u00a0The Government of Bosnia and Herzegovina (\u201cthe Government\u201d) were represented by their Agent, Ms. B. Skalonji\u0107.<\/p>\n 5.\u00a0\u00a0The applicants complained under Article 6 \u00a7 1 of the Convention about the excessive length of civil proceedings concerning damages and various property issues.<\/p>\n 6.\u00a0\u00a0On 11 January 2018 and 23 February 2018 the Court received friendly settlement declarations signed by the parties under which the applicants agreed to waive any further claims against Bosnia and Herzegovina in respect of the facts giving rise to these applications against an undertaking by the Government to pay Ms\u0160ahaIm\u0161irovi\u0107 (application\u00a0no.\u00a078628\/17) 750 euros and MsSabiraEmki\u0107 and Ms. Fata Emki\u0107 (application no.\u00a079133\/17) 750 euros jointly to cover any and all non-pecuniary damage, as well as additional 500 euros to Ms\u0160ahaIm\u0161irovi\u0107 and 500\u00a0euros to Ms\u00a0SabiraEmki\u0107 and Ms Fata Emki\u0107 jointly to cover any and all costs and expenses, which will be converted into the national currency at the rate applicable on the date of payment and will be payable within three months from the date of notification of the decision taken by the Court. In the event of failure to pay this sum within the said three-month period, the Government undertook to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.<\/p>\n 7.\u00a0\u00a0The payment will constitute the final resolution of the cases.<\/p>\n THE LAW<\/strong><\/p>\n 8.\u00a0\u00a0Having regard to the similar subject matter of the applications, the Court finds it appropriate to order their joinder (Rule 42 \u00a7 1 of the Rules of Court).<\/p>\n 9.\u00a0\u00a0The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications.
